M. Kennedy called the meeting to order at 7:00PM

 

TROUT BROOK DAM IMPROVEMENTS- Dredging Pond

 

Dan Hazen, DPW was present at the meeting.  He stated that DPW had been doing dam repairs at Trout Brook and due to the drought they were able to do a number of repairs. He stated that they were able to pull about 36” of sediment from the spillway and he was at the meeting to ask the Commission what they wanted to be done to the pond itself.   He stated that right now they can dredge a little upstream to the filter system.  He stated that they can compost and recycle the material and then deepen the pond in order to given the fish a better environment.

 

D. Hazen stated that they also wanted to repair the two pavilions that were on the property.  He stated that they would like to do some pruning of the trees and take the building down and rebuild them.   He asked the Commission what they would like to see for the project.

 

M. Kennedy asked if they would be replacing the structures with similar ones. 

 

D. Hazen replied they would be

 

M. Kennedy asked if they would need additional permitting for dredging the pond.

 

D. Hazen replied that as per DCR, the Conservation Commission owns the property so they would need to be a signatory on the paperwork.

 

M. Kennedy asked if the sediment had been tested.  D. Hazen replied it had not yet been tested but that they could test it.

 

M. Kennedy stated that they would need to test it in order to get the 401.  He stated that it seemed like a good idea and asked if it was all town labor.

 

D. Hazen replied that it was Town labor.  He stated that the climate (drought) had led itself to the opportunity to do this work and he was before the Commission asking for guidance and permission with moving forward.

 

R. Lowell stated he was concerned as to what they would be doing with the spoils and asked what they would be doing for the already stressed wildlife management.

 

D. Hazen stated that the pond is basically barren.  He said he did some soil augers around the border and what he found was between 12” and 30” of sediment before he found the  original gravel base.   

 

R. Lowell replied that there were still some fish in there and he cautioned D. Hazen to be careful if they were doing excavation.

 

M. Kennedy stated that they would need to know the stage of construction for the 401, dewatering plan, the quality of the sediment, and what the sediment would be reused for.  

 

D. Hazen replied he would have all that information.  He stated that the sediment would be used for street sweeping compost and there were restrictions on that as well.

 

D. Hazen asked if the Commission was supportive of moving forward.

 

The Commission replied that they were.

 

Motion by K. Strom, seconded by M. Krikonis, it was UNANIMOUSLY VOTED TO AUTHORIZE D. HAZEN, DPW TO MAKE PLANS AND SUBMIT THE APPROPRIATE APPLICATIONS FOR PERMITS FOR DREDGING THE POND AND TO REBUILD THE PAVILLION AS AN OVERALL IMPROVEMENT PLAN.

M. Kennedy opened up all three lots of the Wingspan Properties. 

 

G. Williamson read the public hearing notice into record.

 

J. Finlay, Finlay Engineering and Bill George, Wingspan Properties were present.

 

J. Finlay stated that the lots were half acre lots accessed by common driveways.  He showed the Commission the wetland area and stated that Eco Tec Inc had flagged the land as well. He showed them the areas on the plans in yellow for the 25FT no disturb and the blue area was the secondary protection zone from DCR for a stream that was determined to not be perennial by Eco Tec.   He showed the Commission a large area and stated it was an isolated wetlands. J. Finlay stated that there was a Zone A from DEP and Scott Morrison, Eco Tec had met with DEP and the Zone A was moved.

J. Finlay stated that there was some work in the buffer zone.  He stated that they were extending the sewer on Fisher Road 280 FT to the centerline of Fisher Road shy of Station 15 and that was approved by DPW. 

 

J. Finlay told the Commission that the Planning Board had approved the common driveway permit. 

 

J. Finlay stated that for lot 3 the only work in the buffer zone was the grading between the driveway and the overflow from the recharge trench and some footing drains.  He stated that the site has been elevate for a footing drain.  J. Finlay showed the Commission the black lines that were the control barriers of hay bales and silt fences that would surround the working area. 

 

M. Kennedy asked if the Town had looked at the wetlands.

 

G. Williamson stated that herself and P. Harding had looked today (October 5, 2016) and the delineation looked fine. 

 

M. Kennedy asked if the wetlands sloped towards the property. 

 

J. Finlay replied that it did.  He stated there was a ridge so the flow is coming across the driveway and down and over the concrete sidewalks to the curve and then back to the property.

 

R. Lowell stated that one concern with the common driveway and the utility trench, they may want to consider a dam or impervious structure so they don’t drain the wetlands.  He stated that they may want to consider doing that the utility trenches don’t end up being a conduit to drain the wetlands.

 

M. Scott asked if the area was all wooded. 

 

J. Finlay replied that it was.

 

M. Kennedy opened it up for public comment.

 

William Barrett, 663 Salisbury Street was present at the meeting.   He asked who received notification of the work for this project.

 

M. Kennedy replied that abutters received notification.  P. Harding replied abutters within 300FT got notice.

 

W. Barrett asked if there was anything that would happen inside the wetlands.

 

M. Kennedy replied that there was not.

 

J. Finlay stated that the wetlands on this property was an isolated pocket.  

W. Barrett stated that he lives next to the cul de sac and he was not sure if the wetlands there would be impacted.

 

M. Kennedy replied that they were not doing much grading so it would not impact the wetlands.

 

W. Barrett asked if there was limitations if you are building on wetlands.

 

M. Kennedy replied that they were not able to build in the wetlands.  He stated that generally the only reason that a builder would be allowed to go into the wetlands was if they were unable to access their property without doing so.

 

W. Barrett asked about Mark Circle and the exception that was granted for the setback.

 

M. Kennedy replied that would be a Zoning Board issue.

Motion by R. Lowell, seconded by K. Strom, it was UNANIMOUSLY VOTED TO CLOSE THE PUBLIC HEARING FOR NOTICE OF INTENT WINGSPAN PROPERTIES, LOT 1, LOT 2, AND LOT 3, FISHER ROAD DEP FILE NUMBER 183-   , 183-    AND 183-    ASSESSING MAP AND PARCEL 234-1 SINGLE FAMILY.

 

Motion by R. Lowell, seconded M. Scott, it was UNANIMOUSLY VOTED TO APPROVE THE NOTICE OF INTENTS FOR WINGSPAN PROPERTIES, LOT 1,2, AND 3 WITH THE STANDARD ORDER OF CONDITIONS PLUS THE ADDITION OF A TRENCH DAM BARRIER IN EACH SEWER TRENCH, PERMANENT DEMARCATION OF THE 25FT BARRIER, AND SUBJECT TO RECEIPT OF THE DEP FILE NUMBERS.

P. Harding stated that the lot was ready and stable and had been inspected.

 

Motion by R. Lowell, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO ISSUE THE REQUEST FOR CERTIFICATE OF COMPLIANCE FOR HCC-0415; 49 JORDAN ROAD (LOT 40) KENDALL HOMES, OAK HILL SUBDIVISION. 

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- DEP File #183-579 231 Bailey Road, Map/ Parcel 185/ 71 Michael And Marie-Anne Lavallee

 

The Conservation Agent, Glenda Williamson, contacted the applicant’s representative, Julian Votruba with New England Environmental Design, to ask permission to go on the property.  After having obtained permission from the landowner, Marie-Ann Lavallee, the October 3rd site inspection revealed that the lot was sufficiently stabilized to issue the requested Certificate of Compliance. 

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO ISSUE THE REQUEST FOR CERTIFICATE OF COMPLIANCE FOR DEP FILE #183-579, 231 BAILEY ROAD, MAP/ PARCEL 185/71 MICHAEL AND MARIE-ANNE LAVALLEE.

G. Williamson asked for additional time to review the property.

 

EXTENSION OF TIME 109 ARIZONA AVENUE- LOTS 1 & 2 DEP File #183-528

 

G. Williamson stated this was voted on at a prior meeting and needed to be signed by the Commission.  The Commission signed the extension of time.

 

MOUNT VIEW- Shrewsbury Street- Update on Slope

 

P. Harding stated that they went in and looked at the slope stabilization and they did a good job.  She stated that the slope looks good and they hydroseed was done as well.  She stated that the rip rap slopes are there.  She stated that the pond was full of water though.

 

M. Scott asked if the water was supposed to infiltrate.

 

P. Harding replied it was.

 

M. Kennedy stated it may be clogged

 

K. Strom asked when the Town took over at the property. 

 

P. Harding replied she was not sure.  She stated that there is still some work to be done.

Motion by R. Lowell, seconded by M. Krikonis, it was UNANIMOUSLY VOTED TO APPROVE THE SEPTEMBER 7, 2016 CONSERVATION COMMISSION MEETING MINUTES AS CORRECTED.
