R. Lowell called the meeting to order 7:02

 

NOTICE OF INTENT- Holden Youth Soccer League-183-643 Bullard Street.  Assessing Maps 164, 150 Parcels 16 and 43.  Patrick Healy, Thompson-Liston Assoc., Construction of two new soccer fields, access driveways, parking, stormwater management facilities and grading within the buffer zone. Cont from October 4, 2017.

 

R. Lowell stated that they had received additional letters with clarification from DPW dated October 31, 2017 that responded to questions for sizing of the basin.

 

P. Harding stated that the Town had received them yesterday and had not had the chance to review them yet.

 

R. Lowell asked if the proponent was present at the meeting.

 

G. Williamson suggested skipping this matter and coming back to it.

Glen Krevosky was present on behalf of Ed Jardus.  He stated that there were comments relative to having the surveyor stamp not be Quinn so it was added to the plan as well as the date of the delineation when the flags were rechecked. He stated that there was a blow out for the concrete structure.

 

G. Krevosky stated that there was a headwall that dumped into a basin and hole going out the side of the basin on the east side. He stated he could send photos over along with the fill.

 

K. Strom asked if it was the fill by flag 22A and 21A.

 

G. Krevosky replied it was up the road on the east side of the easement at flag 20.

 

R. Lowell stated that seemed to address some of the questions from the October meeting. He asked the Commission if they had any additional questions.

 

K. Strom asked if the Town had walked it.

 

G. Williamson stated that everything was on the plans that they had asked for.

 

R. Lowell asked if the public had any questions; no members of the public stepped forward.

 

Motion by K. Strom, seconded by M. Scott, it was UNANIMOUSLY VOTED TO CLOSE THE PUBLIC HEARING FOR ANRAD 183-646 GREYSTONE DRIVE AND RESERVOIR STREET ASESSING MAP 171, PARCELS 52 AND 40.

 

Motion by K. Strom, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO APPROVE THE ANRAD FOR 183-646 GREYSTONE DRIVE AND RESERVOIR STREET ASSESSING MAP 171, PARCELS 52 AND 40 AS DELINIATED ON THE NEW PLAN FROM JUNE 2017.

K. Strom and M. Scott recused themselves from this matter.

 

Patrick Healy was present on behalf of HYS.  He stated that when they left the hearing in October, there were a few items outstanding to address.

 

P. Healy stated that they had responded to the comments and he believes they are down to a few items for water and sewer.  He stated two issues were for stormwater but he believed they were close to resolution on that.  He stated that biggest question was stormwater calculation.  He stated the applicant was proposing synthetic turf and there was a curve number of 72.  He stated that DPW had asked them to justify the curve number for natural versus synthetic and to justify that if you use SCS method if comes out lower than grass. He stated part of that was that there was crushed stone under the synthetic turf and it contributed to store part of the run-off and then it goes to the basin.  He stated the synthetic goes to the infield and subdrains and then the drains.  He stated they went through a number of steps on this.

 

P. Healy stated the other outstanding issue with respect to stormwater was infiltration.  He stated that he believes they had documented that and they just needed DPW to verify that they had answered the question. He stated that he thinks the plans were complete and they made the changes and submitted a revised set of plans. He stated they were down to working on a few of the finer points but he does not expect that to affect the scope of work.

R. Lowell asked what materials the synthetic turf was made out of.

 

P. Healy replied it was not specified but it was usually crumb rubber infield.

 

R. Lowell stated that regarding runoff they wanted to know if it required anything further regarding residual runoff quality.

 

P. Healy stated that there was information that he submitted from a study over the course of several years and cases.

 

R. Lowell stated that he thinks the Commission would want a copy of that.  He asked if there was anything different in the colorant.

 

P. Healy replied that it was painted with a thin athletic field paint that was repainted once a year and was a lead free paint.

 

L. Boucher stated that he did not recall the detail; he asked if the subdrain was on the bottom of the crushed drain or if there was storage below.

 

P. Healy showed a plan with a cross section and detail showing that around the perimeter there was a 12” pipe so it was subgrade and crowed herringbone pattern in the field.  He stated if the field is constructed on a ledge area there would be an additional 4” of stone.

 

R. Lowell opened it up for public comment; no member of the public stepped forward. 

 

R. Lowell asked if the Commission should hold off from final sign off from DPW.

 

P. Harding replied it was up to the Commission. 

 

L. Boucher stated that he felt that while it sounded close it was hard to give the green light to a project without DPW sign off on stormwater related items.

 

R. Lowell suggested holding off until they had DPW determination.  He suggested that they look at some sort of fencing to protect the ponds once the fields were finalized.

 

P. Healy stated that they did propose a 5ft chain fence to prevent access and once in operation they would determine if anything else was needed.

 

The Commission continued the matter to the December 6, 2017 Conservation Commission meeting.

 

K. Strom and M. Scott returned to the meeting.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- Stoney Brook Estates 183-493  Subdivisinon, Assessing Map 184/171 Parcels 5/18 and 22, 290 Reservoir Street, Clea Blair con’t from October 4, 2017

 

R. Lowell asked for an update on this matter.

 

G. Williamson stated that they were waiting on more information. 

 

R. Lowell stated they were waiting on a letter from New England Environmental Design. 

 

P. Harding handed out the letter. 

 

L. Boucher recused himself from the matter.

 

K. Strom asked if I. McCauley, DPW had reviewed the letter yet.

 

P. Harding replied that they had just received it.

 

M. Krikonis asked if this was in response to questions from I. McCauley.

 

P. Harding stated that I. McCauley wanted stormwater better addressed.  She stated the applicant submitted a book of calculations and this with it but it was just submitted so she had not had the opportunity to look at it.

 

R. Lowell asked how the obligations had changed now that it was a shallow marsh; he asked if it was now a regulated wetlands.

 

P. Harding replied that she did not think so.

 

R. Lowell stated it was the same requirements then.  He stated that they had not had the chance for DPW do comment.  He asked the applicant how the shallow marsh system effected the long term maintenance plan.  He asked if it would change the maintenance schedule or burdens or requirements to the system.

 

C. Blair stated that what happened before was the space grew cat o’nine tails and that functionally this would be easier to maintain.

 

R. Lowell asked if there were any long term ramifications to the change.

 

C. Blair replied there was not.  He stated that the Town no longer used sand and he does not see any place that it would cause more maintenance than a detention pond.

 

R. Lowell stated that he understood vegetative uptake is a plus but he asked about flood control.

 

C. Blair stated that it met all the stormwater calculations.

 

R. Lowell stated that the Commission would wait to hear from DPW.  The matter was continued to the December 6, 2017 Conservation Commission Meeting.

 

L. Boucher returned to the meeting. 

 

NOTICE OF INTENT- 1665 Main Street- Mill Pond Realty Trust- 183-xxx

Assessing Map, Parcel 94, Julian Votruba, NEED, LLC.  Rehabilitation of existing mill buildings to serve as residential units; infrastructure and landscape improvements within the 200ft Riverfront of Asnebumskit Brook.

 

J. Votruba stated that they did not have the DEP file number yet.

 

William McCabe, Attorney for Mill Pond Realty was present at the meeting.  He stated that the Commission had conditions from 2012 that had expired and that was why they were back applying for building permits so they needed an updated Order of Conditions.

 

J. Votruba stated that he had become involved in the project after the original Order of Conditions were issued.  He stated that his involvement was dealing with a concrete slab that they were going to try to make into a courtyard.  He stated that after dealing with DCR, they had some concerns about the integrity of the slab and that did not pan out so DCR wanted to remove the concrete slab that was straddling the river.  He stated they got a variance and they were going to restore the river bed and he gave that information to DCR.  He stated they were basically going to cut it up and truck out the cut pieces and whatever fell they were going to pick it up.  He stated the riverbed gets restored and its all rock and boulders so it is a good base to restore.  He stated that nothing had changed from the design plans; there was the same parking, stormwater calculations and stormwater management.  He stated they had resubmitted the old filings along with the new one for review.

 

R. Lowell stated that the scope of work was in the wetlands resource.  He stated they were talking about slab removal and construction plans as well.

 

J. Votruba stated that the construction plans were the same as before and they were not changing anything.  He stated that there were three stormceptors.  He stated that they engineered it in a way to not undermine it but to capture the runoff and do stormceptors and discharge.

 

R. Lowell asked if the slab served as part of the spillway.

 

J. Votruba stated that it was; it was the way the water passed through.

 

K. Strom asked what was going to happen to the piers.

 

J. Votruba stated that they were going to cut them or pull them out.

 

K. Strom asked how deep they were.

 

J. Votruba replied he was not sure.

 

R. Lowell stated that the Commission wanted to understand what the disturbance would be. 

 

J. Votruba stated that removing the pile was what was proposed.

 

K Strom stated that it was substantial; 2-3 feet.

 

J. Votruba replied it was 5 feet.  He stated onsite there was an existing loading dock so the heavy equipment could land. 

 

R. Lowell asked about erosion controls.

 

J. Votruba stated that they were going to use sandbags and draw the water down and then put the boards in to hold the water from coming back in and do a temporary pipe.  He stated they were  trying to keep any flow of the pond from washing through the site.  He stated that once that was done they will have haybales and silt and have it armored well until the rip rap is along the edges and the site was stable.

 

R. Lowell asked if they were going to lower the level of the pond.

 

J. Votruba confirmed and stated it would be lowered to about 4ft.

 

R. Lowell asked if this was part of the agreement with the dam owners.

 

L. McCabe stated that Mill Pond owns the northern side and White Oak owns the southern side.

 

K. Strom asked about the timing with regards to flow.

 

J. Votruba replied that the key was to schedule it with fair weather.  He stated that it was heavy equipment and it should not take more than a week to do the work.

 

R. Lowell asked about the DCR letter.

 

P. Harding replied it was in the packet.  She told the applicant to make sure they referenced the previous Order of Conditions.

 

G. Williamson asked them to show where the existing stormceptors and catch basin were located on the plan.

 

J. Votruba showed the location.

 

G. Williamson asked if the catch basins would be cleaned.

 

R. Lowell asked if there were any existing basins within the course of demo area and egress.

 

J. Votruba replied there were not in the demo area. 

 

G. Williamson disagreed.

 

R. Lowell stated that it would need to be protected.

 

G. Williamson stated there were also two between building 3 and 5.

 

J. Votruba stated that there was not any demo occurring there.

 

R. Lowell asked what the method for the slab demo would be.

 

J. Votruba replied it was with an excavator to break it apart and load it at the same time. He stated once they have a demo contractor he will pass the information along to the Commission but they will break it up in pieces as large as possible.  He stated that they will have to pick up the debris daily and that they will have some type of protective blanket but the final clean up would be by hand.

 

R. Lowell asked if there was any void space under the existing spillway.

 

J. Votruba replied not that he had seen.

 

R. Lowell stated that it was right next to the dam.

 

K. Strom stated that his concern was with the integrity of the dam.

 

R. Lowell asked if the removal changed the behavior of the dam.

 

J. Votruba stated that the dam was classified as unsafe.

 

R. Lowell stated that DCR did not make engineering comments for dam safety.

 

L. McCabe stated that it was beyond the scope of what DCR reviewed.

 

K. Strom pointed out that there were two portions of DCR.

 

R. Lowell asked how the spillway was going to behave.

 

K. Strom stated that his concern was the piers; he suggested cutting them flush.

 

J. Votruba stated that they could make that suggestion.

K. Strom stated that the most disturbance would be with the pier removal.

 

R. Lowell stated it was a wetland resource area so it was of primary concern. He asked for them to get an opinion on K. Strom’s suggestion.

 

J. Votruba replied he would get an expert opinion on that.

 

R. Lowell stated that they wanted to make sure the proposed work did not create additional complications.

 

R. Lowell stated he would also like the erosion controls to creep back.  He stated that the Commission was looking for more assurances about the outcome of the work.

 

J. Votruba asked if the Commission would be satisfied if they just cut the piers.

 

L. Boucher stated that part of the concern was if the slab was that close then the slab could be preventing water from scouring.  It was clarified that the water flows completely under the slab.

 

J. Votruba replied he would get more information.

 

L. Boucher asked if the sizing of the flume pipe was sized for a certain design event or if it was just arbitrary.

 

J .Votruba replied it was arbitrary.  He stated they were banking on the Eagle Lake draw down having the levels dropped down and then do the work. He stated the proposed pipe size would be sufficient.

 

A Costello asked what time of year they would be doing the work.

 

J. Votruba replied they were looking at the beginning of the summer.

 

L. McCabe stated that during the construction they proposed water levels would be 1ft -1.5 feet and then the logs would be replaced.

 

G. Williamson asked how much natural vegetation could be maintained.

 

J. Votruba replied that they were going to loam and seed and make the bank a green place for people.

 

G. Williamson encouraged him to leave as many trees as possible.

 

J. Votruba agreed.

 

A Costello stated that the area between building three and five was described as landscaped.  He asked if that meant turf.

 

J. Votruba replied loam and seed.  He stated right now it was brush and overgrowth.

 

A Costello stated there was a wall that was broken as well.

 

J. Votruba replied that he was certain they would fix what is in disrepair. 

 

K. Strom stated that there were hydraulic calculations submitted for DCR and lowering it 1-1.5 feet. 

 

P. Harding stated that the end of the summer is when the draw down was currently scheduled for Eagle Lake.

 

K. Strom stated that the appeal was thrown away so the work could be done under those conditions.

 

J. Votruba stated there was no problem waiting for the driest time.

 

K. Strom suggested coordinating it with the drawdown.

 

P. Harding stated it would be 6”/week so 9 weeks.

 

L. Boucher asked if the drawdown was temporary.

 

K. Strom replied that they were going to leave it down.

 

R. Lowell asked if any members of the public had any questions; no members of the public stepped forward.

 

R. Lowell continued the matter to the December 6, 2017 Conservation Commission meeting.

 

DISCUSSION- FISHER ROAD LOT 1-WINGSPAN 183-633

Proposed Driveway Crossing; Scott Morrison Eco-Tec, Inc.

 

Scott Morrison was present on the matter along with Bill George.

 

S. Morrison stated that what happened was there was an Order of Conditions for the lots.  He stated that they had been approached with several deposits on homes however people did not want to purchase them with a common driveway.  He stated they looked into the possibility of splitting off the driveway and adding a new one.  He stated the big question is with regards to the bordering wetlands in Wachusett Watershed.

 

S. Morrison stated that the water drains to a tributary stream to the north great than 100ft away.  He stated that they had done work previously with DEP and determined that the water was not a connection and revised the Zone A accordingly.  He stated it was an isolated wetlands.

 

S. Morrison stated that it was not classified as a resource area and that they wished to revise the existing Order of Conditions for lot one and wanted to have the Commissions feedback.  He stated that they would wrap around the forested area and do replication to minimize disturbance.  He asked the Commission if they had any questions or could provide them with feedback to accomplish this.

 

R. Lowell asked if this was the only lot in this.

 

S. Morrison replied that there 8 lots total.  He stated he was not sure how many had an Order of Conditions but that some had work outside the buffer.  He stated for three of the properties, the water drained to better soil and then extended to sheet flow and then infiltrates.

 

K. Strom asked if there was any channel.

 

S. Morrison replied there was no channel.  He stated that as you go further down it disappears.  He stated there were some oaks up there so it was marginally wetter on the top and then flows down to flatten so it did not create a channel.  He stated proposed replication along the street would be the best.

 

R. Lowell asked if they would be creating another isolated wetlands if they put a driveway there.

 

S. Morrison stated he would do a culvert to ensure that this was hydrologic connectivity. He stated the other important thing was that utilities went through so they wanted to keep the utilities where they were and propose the driveway change.

 

G. Williamson asked if the Commission would rather a revised NOI for the driveway and replication or a new NOI for new work.

 

R. Lowell replied a new one would make the most sense.

 

K. Strom asked if all the work was being done on lot 1.

 

S. Morrison confirmed that.

 

K. Strom asked if they should issue a new NOI.

 

P. Harding replied it could be easier.

 

S. Morrison stated that his only concern was that DEP frowns on two Order of Conditions for the same project.  He stated they could still do the legal notice and abutter notifications. He asked if the Commission could amend it instead.

 

R. Lowell stated he was suggesting a new one.  He asked how the original was filed.

 

L. Boucher stated that they could do it with the same DEP number and the applicant would not have to close one out.

 

R. Lowell stated they would need new public notice made to the abutters.

 

G. Williamson left the meeting at 8:12PM.

 

The Commission suggested that they revised the NOI with the new plans.

 

G. Williamson returned to the meeting at 8:13PM.

 

G. Williamson asked if they needed to revise the plans for lot 2.

 

S. Morrison stated they could amend them both at the same time.

 

P. Harding stated that she thought hey needed a new plan not a new filing.

 

L. Boucher stated that lot 2 was minor.

 

S. Morrison asked when the filing deadline was.

 

P. Harding replied 2 weeks.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- 183-471.  Lot 24 Shady Lane. Wachusett Woods. Assessing Map 118 Parcel62.  Michael Krikonis. Single Family, dry well, diversion swale and grading in the buffer zone. Spring 2006. 

 

G. Williamson stated that she did a site visit and it looked good and stable.  She took pictures of the swale and it was diverting.

 

K Strom asked about demarcation.

 

M. Krikonis stated there were plantings but some needed to be replaced.

 

Motion by K. Strom, seconded by L. Boucher, it was VOTED TO APPROVE THE ISSUANCE OF THE CERTIFICATE OF COMPLIANCE FOR 183-471// SINGLE FAMILY, 10 SHADY LANE BY A VOTE OF 5-0-1 (Krikonis: abstain)

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- 183-468 Lot 21, 16 Shady Lane. Wachusett Woods. Assessing Map  118 parcel 59. Edward Adu-Gyamfi, Single Family, dry well, diversion swale and grading in the buffer zone.  Spring 2006.  

 

G. Williamson stated she did a site visit and it was stabilized.  She stated there was a high berm that was physically blocking the house from the wetlands.

 

Motion by M. Scott, seconded by A. Costello, it was UNANIMOUSLY VOTED TO APPROVE THE ISSUANCE OF THE CERTIFICATE OF COMPLIANCE FOR 183-468 Lot 21/ 16 SHADY LANE.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- Holden Towers Tennis Club 183-614 38 Brattle Street, Assessing Map 202, Parcel 127 & 131.  Tennis Court construction, stormwater management basin and gravel parking area

 

R. Lowell asked if this had been completed.

 

K. Strom stated that there was a statement from Graves Engineering.

 

G. Williamson stated that it was the long term plan and the O & M Plan.  She stated that the site was stabilized and the only concerning thing she saw was that it appeared that the stormwater structures needed to be cleaned.  She showed the Commission a photo.

 

R. Lowell asked how long ago the picture was taken.

 

G. Williamson replied before the rain.

 

Brian Chandley, on behalf of Tennis Clue stated that they had cleaned the structure out two days ago.

 

R. Lowell asked how the basin behaved.

 

B. Chandley stated that it was empty within a period and drained within 48 hours.

 

G. Williamson asked who was responsible for it.

 

B. Chandley stated that they had a professional landscaper that was responsible for the maintenance of the basin.

 

M. Krikonis stated that he was there and it was clean. He stated the one portion of the rip rap had a lot of growth.

 

G. Williamson asked if the Commission wanted as builts on this.

 

K. Strom replied it was pretty minor site work and there was an affidavit from Don Graves.

 

Motion by K. Strom, seconded by M. Krikonis, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE FOR HOLDEN TOWERS TENNIS CLUB 183-614.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE – 183-626 139 Quinapoxet Street (formerly 143) Assessing Map 10, Parcel 3. Jim Harrity, Integral Builders . Single Family and driveway within the 100-foot buffer.

 

G. Williamson stated that she had looked on October 31, 2017 and it looked stable.

 

Motion by M. Scott, seconded by K. Strom, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE FOR 183-626; 139 QUINAPOXET STREET/ JIM HARRITY INTEGRAL BUILDERS.

The Commission reviewed the pictures. 

 

K. Strom asked what happened.

 

P. Harding stated there was migrating sediment.

 

R. Lowell stated that it was good the structure held up.

 

G. Williamson stated that the pictures were from the previous Tuesday. She stated that they were sent from Eco Tech from the last clean up.  She stated it didn’t look as they go everything as there was still a pile of silt and sand.  She asked if the Commission wanted them to go back and clean it up again.

 

R. Lowell asked if they would get it out with hand buckets.

 

K. Strom asked where the sediment came from.

 

R. Lowell replied that he thought it was from an earlier blow out this year and that it had re-deposited and re-channelized.

 

K. Strom stated he was concerned with the blow outs.

 

M. Scott stated it looked as if it held up.

 

R. Lowell asked if the Commission should ask for further clean up or just monitor it.

 

G. Williamson stated that there came a time when you did more harm then good.

 

K. Strom stated that he was more concerned with the spring.

 

R. Lowell stated they should monitor the site and see how it looked in the spring.

 

EAGLE LAKE- 183-642 White Oak Land conservation- Superseding Orders/ Appeal

 

G. Williamson stated that she put information in the packet for the Commission and it basically said that while there was an appeal, DEP said that the appeal was not from a certified abutter and it was not granted.  She stated that DEP’s last response is that the Order stands.

 

APPROVAL OF MINUTES

 

Motion by M. Krikonis, seconded by K. Strom, it was VOTED TO APPROVE THE SEPTEMBER 6, 2017 CONSERVATION COMMISSION MEETING MINUTES AS AMENDED BY A VOTE OF 5-0-1 (L. Boucher: abstain).

 

October Meeting Minutes held until December meeting.

 

MISC

 

P. Harding introduced the Commission to Dave Nyman.  She stated that for those who did not know. D. Nyman was appointed to the Commission on November 20, 2017.  The Commission welcomed him.

 

R. Lowell stated that DCR had a historic curator putting a bid out for Mount Wachusett for a caretaker. 

 

P. Harding stated that she wanted to make the Commission aware that there was a notice from the National Park Service for Holbrook lot 5.  She stated it needed to be closed by June 30, 2018 and that the cost of the property was $200,000.  She stated the state awarded $100,000 and Greater Worcester Land Trust and White Oak were going to match it.  She stated that the Conservation Commission will own it and Great Worcester Land Trust and White Oak will have the CR.

 

K. Strom stated that he was in another town and someone skyped into the meeting.  He stated that the audience was unable to see the person and according to the Board of Selectmen this was not allowed.  He asked if other Boards were considering this.

 

P. Harding replied they were not and they did not have the equipment to do so.

 

L. Boucher asked for a particular matter could someone participate for a small piece for a critical item.

 

P. Harding confirmed they could.

 

The Commission discussed some possibilities of upgrading technology.  P. Harding told the Commission they had access to a laptop and projector.
