Section 8.1 Traffic Rules and Regulations

INTRODUCTION

        At a meeting of the Board of Selectmen, held in Holden on January 1955 the following vote was duly passed:

The Board of Selectmen of the Town of Holden, acting by virtue of the power given it by Section 22 of Chapter 40 of the General Laws of Massachusetts and by virtue of any other power it hereto enabling, hereby adopts and makes the following rules and orders for the regulation of traffic upon the streets and highways of said town, the same to be known as Traffic Rules and Orders of the Town of Holden.

For the purpose of these rules and orders, the words and phrases used herein shall have the following meanings except in those instances where the context clearly indicates a different meaning.

(a)     "Street or Highway."    The entire width between property lines of every way open to the use of the public for purposes of travel.

(b)     "Roadway."      That portion of a street or highway between the regularly established curb lines or that part, exclusive of shoulders, improved and intended to be used for vehicular traffic.

(c)     "Lane."   A longitudinal division of a roadway into a strip of sufficient width to accommodate the passage of a single line of vehicles.

(d)     "Vehicle."      Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including bicycles when the provisions of these rules are applicable to them, except other devices moved by human power or used exclusively upon stationery rails or tracks and devices which derive their power for operation from stationery overhead wires. (e)     "Parking."      The standing of a vehicle, whether occupied or not otherwise than temporarily for the purpose of and while actually engaged in loading or unloading, or in obedience to an officer or traffic signs or signals, or while making emergency repairs or, if disabled, while arrangements are being made to move such vehicles.

(f)     "Crosswalk."    That portion of a roadway ordinarily included within the prolongation or connection of curb lines and property lines at intersections, or at any portion of a roadway clearly indicated for pedestrian crossing by lines on the road surface or by other markings or signs.

(g)     "Railroad Crossing."    Any intersection of ways with a railroad right-of-way.

(h)     "Official Traffic Signs."       All signs, markings and devices, other than signals, not inconsistent with these rules and orders, and which conform to the standards prescribed by the Department of Public Works of the Commonwealth of Massachusetts and placed or erected by authority of a public body or official having jurisdiction, for the purpose of guiding, directing, warning or regulating traffic.

(i)     "Officer."      For the purpose of these rules and orders an officer shall be construed to mean any police officer, (any constable) or special officers, provided he has his badge of office displayed over his left breast and upon his outer garment.

(j)     "Emergency Vehicles."   Vehicles of the Fire Department, police vehicles, ambulances and emergency vehicles of federal, state and municipal departments or public service corporations when the latter are responding to an emergency in relation to the police or fire departments.

(k)     "Official Street Marking."      Any painted line, legend, marking or marker of any description painted or placed upon any way which purports to direct or regulate traffic and which has been authorized by the Board of Selectmen and which has the written approval of the Department of Public Works, Commonwealth of Massachusetts.

(l)     "Intersection."         The area embraced within the extensions of the lateral curb lines, or, if none, then the lateral boundary lines, of intersecting ways as defined in Section 1 of Chapter 90 of the General Laws, including divided ways.

The rules and regulations herein contained governing and restricting the movement of vehicles at and near intersecting ways shall apply at any place along any way at which drivers are to be controlled by traffic control signals whether or not such place is an intersection as herein defined. (As amended 4-30-73)

It shall be the duty of the police department to enforce the provisions of these rules and orders. Officers of the Police Department are hereby authorized to direct all traffic either in person or by means of visible or audible signal in conformance with the provisions of these rules and orders, provided that in the event of a fire or other emergency to expedite traffic or safeguard pedestrians, officers of the Police or Fire Department may direct traffic, as conditions may require, notwithstanding the provisions of these rules and orders.

The Police may close tempor-arily any street or highway in an impending or existing emergency, or for any lawful assemblage, demonstration or procession provided there is reasonable justification for the closing of such street.

The police may prohibit temporarily, parking on any street or highway or part thereof in an impending or existing emergency, or for a lawful assemblage, demonstration or procession provided there is reasonable justification for such prohibition. Vehicles parked in places where parking is prohibited temporarily may be moved by or under the direction of an officer.

Drivers of vehicles shall comply with any lawful or reasonable order, signal or direction of any officer.

(a)     The police shall maintain a suitable system of filing traffic accident reports. Accident reports or cards referring to them shall be filed by dates or by location alphabetically.

(b)     As the accidents at any particular location become more numerous, the police shall study such accidents and inform the Town Manager of their findings and conclusions, and he will advise the Selectmen.

The police shall submit a traffic safety report annually in the month of January to the Town Manager and he will pass this information on to the Selectmen.

(1)     The number of traffic accidents, the number of persons killed and injured and other pertinent accident data.

(2)     The number of traffic accidents investigated, the number of hazardous locations studied, the number of drivers with bad records interrogated and other pertinent data on the safety activities of the police.

(3)     The plans and recommendations for future traffic safety activities.

The provisions of these rules and orders shall not apply to operators actually engaged in work upon a street or highway closed to travel or under construction or repair, to officers when engaged in the performance of public duties nor to drivers of emergency vehicles while operating in an emergency and in performance of public duties when the nature of the work of any of these necessitates a departure from any part of these rules and orders. These exemptions shall not, however, protect the driver of any vehicle from the consequences of a reckless disregard of the safety of others.

(a)     The Board of Selectmen is hereby authorized and as to those signs and signals required hereunder it shall be its duty, to place and maintain or cause to be placed and maintained all official traffic signs, signals, markings and safety zones. All signs, signals, markings and safety zones shall conform to the standards as prescribed by the Department of Public Works of the Commonwealth of Massachusetts.

(b)     Sections 2 and 3 of Article II, and Sections 2 and 7 inclusive of Article IV, relating to Parking shall be effective only during such times as official signs are erected and maintained in each block designating the provisions of such sections and located so as to be easily visible to approaching drivers. Sufficient number of such signs must be provided so that a car cannot be parked in a limited or prohibited parking place without having the legend side of such a sign, clearly setting forth the parking regulation threat, visible from that location.

It shall be unlawful for any person to place or maintain or to display upon or in view of any street any unofficial sign, signal or marking which purports to be or is an imitations of or resembles an official traffic sign, signal, marking or device, or which attempts to direct the movement of traffic or which hides from view any official sign or signal. The Chief of Police hereby is empowered to remove every such prohibited sign, signal or marking or cause it to be removed, without notice.

It shall be unlawful for any person to willfully deface, injure, move, obstruct or interfere with any official traffic sign, signal or marking.

No driver of any vehicle shall disobey the instructions of any official traffic control signal, sign, marking, marker or legend, unless otherwise directed by a police officer.

(a)     Traffic control signals shall be operated in strict accordance with the requirements and stipulations of applicable permits received from the Department of Public Works, Commonwealth of Massachusetts.

(b)     Changes in the sequence of operation of traffic control signals are not to be made without the written approval of the Department of Public Works, Commonwealth of Massachusetts.

(a)     Provide a DO NOT ENTER sign at Mountview School Exit.

No person shall stand or park a vehicle in any of the following places or in violation of any of the following provisions. Vehicles found parked in violation of any provision of this section may be moved by or under the direction of an Officer and at the expense of the owner to a place where parking is permitted. The owner of any such vehicle that has been tagged in violation of this section shall be subject to the fines as prescribed.

EXCEPTION:              When necessary to avoid conflict with other traffic or in compliance with the direction of a Police Officer or Traffic Sign or Signal.

FIRST AND SUBSEQUENT OFFENSE FINES ARE AS FOLLOWS:

01     Meter Violation

02     Overtime

03     Within 20 feet of an intersection

04     Upon any sidewalk

05     Upon any Crosswalk

06     Upon any roadway in a rural or sparsely settled district

07     Left Side to Curb or Roadway

08     Upon any roadway where the parking is permitted and both right wheels are not within 12 inches from curb or edge of roadway.

09     Upon anywhere the parking of a vehicle will not leave a clear and unobstructed lane 12 feet wide in each direction for passing traffic.

10     Upon any Street or Highway where the parking of a vehicle will obstruct or hide from view any traffic sign, signal or device including pedestrian actuated traffic control lights.

11     In any legally posted No Parking Zone or Area.

12     Any person who is the operator of any vehicle that becomes disabled on any roadway in the Town shall cause such vehicle to be repaired and/or removed forthwith. Any delay in repairing or removal that is expected to exceed two hours shall forthwith be reported to the Police Department.

13     Within 15 feet of or opposite entrance to Fire Station

14     Double parked on any roadway

15     No vehicle shall be parked or left on any roadway during the hours of 1 A.M. through 6 A.M.

16     Upon or under any bridge

17     Other Violation

18     Upon any roadway within 10 feet of the Fire Hydrant

19     Upon or in front of any private road or driveway without the consent of the owner or leasee of said private road or driveway

20     Upon any private property without consent of owner or leasee

21     Upon any way in such a manner as to impede the removal or plowing of snow and/or ice

22     Within an intersection

23     No person shall park a vehicle on any roadway so as to obstruct public travel

24     Parking illegally in a handicapped parking space.

25     Parking in a Fire Lane.

Upon the following ways or parts thereof parking is hereby prohibited:

(a)     Shrewsbury Street, on the southerly side of Shrewsbury Street from two hundred (200) feet west of Brattle Street to a point opposite the WTAG radio towers, a distance of three hundred (300) feet, east of Brattle Street.

(b)     Shrewsbury Street, both sides from Main Street to a point 150 feet east of Main Street; North side from a point 100 feet west of Chapel Street to a point 200 feet east of Holden Street; South side from a point 100 feet west of Holden Street; both sides from a point 200 feet west of Doyle Road to a point 200 feet east of Doyle Road.

(c)     Maple Street, on the easterly side of Maple Street from Main Street to a point three hundred fifty (350) feet in a northerly direction.

(d)     Town Hall driveway on the southerly side, from Main Street to a point opposite the entrance to the Town Hall a distance of ninety-three (93) feet.

(e)     Town Hall driveway on the northerly side from Main Street to a point at the southwest corner of the Town Hall, a distance of two hundred ninety (290) feet.

(f)     Fire Department driveway on the easterly side of said driveway, from a point at the southwest corner of the Town Hall in a northerly direction a distance of ninety (90) feet.

(g)     Fire Department driveway, on the westerly side of said driveway from the southwest corner of the fire station in a southerly direction a distance of one hundred (100) feet.

(h)     Boyden Road from terminus to terminus a distance of approximately fourteen hundred and fifty (1,450) feet.

(i)     Holden Street, both sides from Shrewsbury Street to a point 200 feet south of Shrewsbury Street.

(ii)    Holden Street, on the southerly side from the Worcester City line to Shrewsbury Street, a distance of 5425 feet.

(j)     Chapel Street, both sides from Shrewsbury Street to a point 120 feet north of Shrewsbury Street.

(k)     Doyle Road, both sides from Shrewsbury Street to a point 200 feet southeast of Shrewsbury Street.

(l)     Traffic islands and Median Islands. Parking is prohibited on and adjacent to all traffic islands and median islands.

(m)     Park Avenue, the northerly side from Main Street (Route 122A) to Pleasant Street.

(n)     Industrial Drive, cul-de-sac, entire circumference.

(o)     Salisbury Street

(p)     Reservoir Street

(q)     Maple Street

(r)     Princeton Street at the intersection of Route 122A in a northerly direction on the easterly side for a distance of 442 feet.

(s)     Princeton Street at the intersection with High Street in a northerly direction on the westerly side for a distance of 44 feet.

(t)     High Street at the intersection of Princeton Street in a westerly direction on the northerly side for a distance of 9 feet.

Shrewsbury Street, both sides from Main Street, (Route 122A) to Doyle Road.

Damon Street (AKA Damon Road)

SECTION 3.      Time Limited Parking. Upon the following streets or parts of streets, parking is limited in duration as to the times indicated as follows:

Park Avenue on the southerly side a maximum of two hours between the hours of 8:00 AM and 4:00 PM during school hours only.

SECTION 4.      Time Limited Parking. In the following public parking lots, parking is limited in duration as to the times indicated as follows:

(a)     Damon House Parking Lot, 1174 Main Street: 15 parking spaces on the side of the parking lot near the Damon House be posted with “2-Hour Parking” signs; and 15 parking spaces on the opposite side be left unrestricted.

(a)     No person shall place, erect or cause to be placed or erected within any sidewalk, street or highway any fixture or structure unless a permit, issued by the Board of Selectmen, or designated representative in the case of town ways or by the Department of Public Works, Commonwealth of Massachusetts, in the case of state highways, authorizing such placing or erection has been granted and is in effect.

(b)     No person, other than one employed directly or indirectly by this town or by the Commonwealth of Massachusetts and while in the performance of necessary public duties, shall at any time, place or leave in any sidewalk, street or highway any article, material or merchandise, or park a vehicle or cart on any sidewalk, street or highway for the purpose of displaying merchandise unless a permit issued by the Selectmen or a designated representative in a case of town ways or by the Department of Public Works, Commonwealth of Massachusetts, in the case of state highways, authorizing the use of the sidewalk, street or highway has been granted and is in effect, except as may be necessary for the reasonable and expeditious loading or unloading of any such article, material, merchandise, cart or vehicle, provided, however, that such property shall never be left so as to obstruct the free passage of pedestrians or vehicular travel.

(c)     Any such fixture, structure or property as referred to in this section which has been erected, placed or left illegally in any street, highway or sidewalk may be moved by or under the direction of an officer and at the owner's expense.

SECTION 1.      Upon the following streets or parts of streets vehicular traffic shall move only in the direction indicated below, provided that a sufficient number of official signs are erected and maintained at each of the exits for each one way street, so that at least one sign will be clearly visible for a distance of at least seventy-five (75) feet to drivers approaching such an exit.

(a)     One way Fruit Street westerly from Main Street (Route 122A) to Pleasant Street.

One way Woodland Road northwesterly from a point in the road known as Sta. 9+62.74 to Sta. 16+42.78 at Highland Street a distance of 680.04 feet.

SECTION 1.      The following streets or portions of streets shall be closed to vehicular and pedestrian access and a sufficient number of signs shall be erected and maintained at the point or points of closure of said streets or portions thereof, so that at least one sign will be visible for a distance of not less than seventy-five (75) feet to motorists approaching the closed point or points of the way.

(a)     Adams Road, at the point of its southerly intersection with Main Street/Route 122A.  Said closure shall commence on November 1, 2003 and shall continue for up to a period of one year.  This regulation is subject to the written approval from the Massachusetts Highway Department.

Hazardous Waste Transportation

SECTION 1.      Transportation of regulated hazardous materials and septage pumped from on site sewer disposal systems shall be prohibited from certain Town ways.

The Town of Holden hereby prohibits the transportation of hazardous materials and sewer septage from the following sections of Town streets.

South Road – from Paxton Road south to Reservoir Street

Reservoir Street – from the easterly end of South Road to Stonehouse Hill Road.

Any vehicle required to be placarded in accordance with Department of Transportation regulations or any septage hauler shall be considered a hazardous materials transporter.

Exceptions: Exceptions will be permitted allowing the local delivery of heating oil or propane to and the removal of sewer septage from residences located on South Road from Paxton Road south to Reservoir Street and on Reservoir Street from the easterly end of South Road to a point approximately 100 feet south of the intersection with Bailey Road.

Every driver of a vehicle, or other conveyance, approaching an intersection of ways where there exists facing him an official sign, bearing the word "stop" and authorized by this section, said sign having apart from this regulation, the written approval by this Department of Public Works, Commonwealth of Massachusetts, and such approval being in effect, shall before proceeding through the intersection, bring such a vehicle or other conveyance to a complete stop at such a point as may be clearly marked by a sign or line, or if a point is not so marked, then at a place between the said "stop" sign and the nearer line of the street intersection. In the case of a line of two or more vehicles approaching such "stop" sign, the drivers of the second and third vehicles in line in any group shall not be required to stop more than once before proceeding through the intersection. This section shall not apply when the traffic is otherwise directed by an officer or by a lawful traffic regulation sign, signal or device.

In accordance with the foregoing the erection and maintenance of an official "stop" sign or signs are authorized so as to face:

(a)     Northbound drivers on Holden Street entering Shrewsbury St

(b)     Southbound drivers on Chapel Street entering Shrewsbury St

(c)     Northwest bound drivers on Doyle Road entering Shrewsbury Street

(d)     Northbound and southbound drivers on Brattle Street entering Doyle Road

(e)     Northwest bound drivers on Woodland Road entering Highland Street

(f)     Southbound drivers on Bullard Street at Shrewsbury St

(g)     Northbound drivers on Brattle Street at Shrewsbury St

(h)     Northbound drivers on Birchwood Drive at Shrewsbury St

(i)     Eastbound and Westbound drivers on Quinapoxet St at Princeton St

(j)     Eastbound drivers on Avery Heights Drive at Route 31

(k)     Eastbound drivers on Jamieson Road at Route 31

(l)     Southbound drivers on Union Street at Route 31

(m)     Eastbound drivers on Nola Drive at Route 31

(n)     Southbound drivers on Manning Street at Route 31

(o)     Eastbound drivers on Mill Street and Route 31

(p)     Westbound drivers on Moscow Road at Route 31

(q)     Westbound drivers on Newell Road at Route 31

(r)     Eastbound drivers on Putnam Road at Salisbury Street

Colors and arrow indication in traffic control signals shall have the commands ascribed to them in this section and no other meanings, and every driver of a vehicle, railway car or other conveyance shall comply therewith except when otherwise directed by an officer or by a lawful traffic regulating sign (other than a "stop" sign), signal or device.

In no case shall a driver enter or proceed through an intersection without due regard to the safety of other persons within the intersection, regardless of what indications may be given by traffic control signals.

1.      Green indications shall have the following meanings:

(a)     Drivers facing a CIRCULAR GREEN may proceed straight through or turn right or left unless a sign at such place prohibits with such turn. But drivers turning right or left shall yield the right-of-way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited.

(b)     Drivers facing a GREEN ARROW, shown alone or in combination with another indication, may cautiously enter the intersection only to make the movement indicated by such arrow, or such other movement as it permitted by other indications shown at the same time. Such drivers shall yield the right-of-way to pedestrians lawfully within an adjacent crosswalk and to other traffic lawfully using the intersection.

2.      Steady yellow indications shall have the following meanings:

(a)     Drivers facing a steady CIRCULAR YELLOW OR YELLOW ARROW signal are thereby warned that the related green movement is being terminated or that a red indication will be exhibited immediately thereafter when drivers shall not enter the intersection.

3.      Steady red indications shall have the following meanings:

(a)     Red - Traffic facing a steady CIRCULAR RED signal alone shall stop at a clearly marked stop line, or if none before entering the crosswalk on the near side of the intersection or if none then before entering the intersection and shall remain standing until an indication to proceed is shown except as allowed by Chapter 89, Section 8 of the General Laws.

(b)     No driver of a vehicle facing a CIRCULAR RED signal indication shall make a right turn where official traffic signs are installed and maintained prohibiting such turn at the following intersections:

(c)     Drivers facing a steady RED ARROW indication may not enter the intersection to make the movement indicated by such arrow, and unless entering the intersection is permitted by other indications shown at the same time, shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or if none, then before entering the intersection and shall remain standing until an indication to make the movement indicated by such arrow is shown.

4.      Flashing signal indications shall have the following meanings:

(a)     Flashing red (stop signal) - When a red lens is illuminated with rapid intermittent flashes, drivers of vehicles shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection, and the right to proceed shall be subject to the provisions of Chapter 89, Section 8 of the General Laws.

(b)     Flashing yellow (caution signal) - When a yellow lens is illuminated with rapid intermittent flashes, drivers of vehicles may proceed through the intersection or past such signal only with caution.

At any junction or crossing of ways where the roadway grades have been separated and where the ways are connected by ramps and at any intersection of ways in which there are traffic islands, drivers of vehicles shall proceed only as indicated by official signs, signals or markings.

Salisbury Street Northbound from a point 50 feet south of Main Street to Main Street.

SECTION 1.      Within the limits of the intersections of Shrewsbury Street and Route 122A, Holden, Chapel and Shrewsbury Street, Shrewsbury Street and Anderson Avenue, Brattle Street and Shrewsbury Street, Doyle Road and Shrewsbury Street, 122A and Salisbury Street, no additional driveways, (residential, commercial or business) and no relocation or alteration of existing driveways shall be permitted which is not in conformance with the Commonwealth of Massachusetts Department of Public Works Manual of Uniform Traffic Control Devices, with particular reference to Location of Drives in Respect to Intersections, without prior written approval of the Commonwealth of Massachusetts Department of Public Works.

If any vehicle is found upon any street or highway in violation of any provisions of these rules and order and the identity of the driver cannot be determined, the owner or the person in whose name such vehicle is registered, shall be held prima facie responsible for such violation.

Except as otherwise provided by statute or by any commission, department or other body authorized by law to impose penalties for violations of rules, regulations and orders governing the use and operation of vehicles, any person convicted of violating any of the provisions of the foregoing rules and regulations shall be punished by a fine of not more than $5.00 for the first offense and not more than $20.00 for each subsequent offense of a like nature committed during any period of one year unless otherwise herein provided.

These rules are adopted with the intent that each of them shall have force and effect separately and independently of every other except insofar as by express reference or necessary implication any rule or any part of a rule is made dependent upon another rule or part thereof.

The provisions of these rules so far as they are the same in effect as those of any valid existing rules, orders or regulations heretofore made by the Selectmen of Holden, Massachusetts, relative to or in connection with official signs, lights, markings, signal systems or devices shall be construed as a continuation thereof, but all other existing rules, order and regulations so made for the regulation of vehicles are hereby expressly repealed. This repeal, however, shall not affect any punishment or penalty imposed or complaint or prosecution pending at the time of the passage hereof for any offense committed under any of the said rules, orders or regulation hereby repealed.
