February 7, 2013

MEMBERS PRESENT:         Mark Johnson, Mary Ricker, Bruce Penino

M. Johnson called the Board of Health Meeting to order at 4:05 PM

 

TOBACCO CONTROL REGULATIONS:

The Board reviewed the ‘Sample Regulation Restricting the Sale of Tobacco Products and Nicotine Delivery Products’ policy checklist.

 

M. Johnson said the $100 fine is not a stiff enough penalty for selling to minors.  The Board discussed what the fines should be.  Derek Brindisi, WDPH, stated that they can not charge more than the $300 fee for non-criminal disposition, the selling of tobacco and nicotine delivery products.  The tolling period recommended is 12, 24 or 36 months.  The Board leaned towards the 24 months.

 

M. Johnson recommended looking at the alcohol regulations as a comparison.

 

A. Crete will resend the ‘Sample Regulation Restricting the Sale of Tobacco Products and Nicotine Delivery Products’ to the Board to review before the next meeting.  Again, M. Johnson would like to see parallel regulations for alcohol.  A. Crete said she would not recommend paralleling the regulations.

 

The Board agreed to review the regulations before the next meetings vote.  A Public Hearing will be required after that.

CENTRAL MA REGIONAL PUBLIC HEALTH ALLIANCE:  A. Crete will email a copy of the report of the last year’s activity to each of the Board members for review.

MEDICAL MARIJUANA:  The law passed January 1, 2013.  Not more than 5 dispensaries are allowed per town.  A doctor’s note will be required, and hardship will have to be proven to be able to grow your own for personal medical use.

MEETING MINUTES:

  • September 18, 2012:  B. Penino motioned to approve.  M. Ricker seconded.  M. Johnson abstained from the vote.  Vote 2-0-1.  APPROVED.

M. Johnson motioned to adjourn the Board of Health meeting.  B. Penino seconded.  All in favor.
