March 18, 2014

MEMBERS PRESENT:         Mark Johnson, Chairman, Mary Ricker, Bruce Pennino

 

OTHERS PRESENT:             Andrea Crete, Board of Health Agent

M. Johnson called the Board of Health Meeting to order at 5:00 PM.

PUBLIC HEARING / TOBACCO REGULATIONS:  M. Johnson read the Public Hearing Notice into record.

Carin O’Donovan, Regional Manager, for Honey Farms, addressed the Board and read a letter regarding single sales into record.  He also distributed a copy of a letter dated March 18, 2014, from the NE Convenience Store Association, into record.

Alex VanKleeck, 358 Quinapoxet St:  Manager at Hess Convenience Store, addressed the Board regarding the new Tobacco Regulations.

Tina Grosowsky, Project Coordinator, Central MA Tobacco Free Community Partnership, UMASS:  Address the Board against single sale products.

Brian Forts, Attorney:  Representing Jack Namiotka, Holden Wine & Spirits, addressed the Board with a discussion of self service humidors.

Karyn Clark:  Read page 6 ‘cigar sales regulated’ into record.

M. Johnson explained the process the Board went through to create these regulations.  They (the Board) are not anti-business, but against targeting the youth.

Brian Forts questions #M2 – asking for clarification of “cooperate”, in reference to inspections.

Karyn Clark explained the Collaborative and how they represent the towns.  She said that she would get the exact wording to be used, and get back to the Board.  She stated that this is a standard model regulation, providing information to protect our youth.

The Board discussed ‘machine made’ vs ‘handmade’.

M. Johnson motioned to table to the next meeting for clarification.  B. Pennino seconded.  All in favor.

Karyn Clark will contact the state for the definition of ‘cooperate’.  The Board also needs clarification of machine or hand rolled.  Karyn will also fix the date on the draft and email to D. Sciascia to forward to the Board members.

The Tobacco Regulations will be online when completed.

SEPTIC REVIEW(S):

  • 2356 MAIN ST.Wayne J. Curran R.S., for Ted Leahy.  They are looking for local upgrade approval for a repair.

A deed restriction is required and needs to be recorded and submitted before the certificate of completion will be issued.  The Board questioned whether the wall is a structure and wants to know the height of the wall.

The plan needs an infiltrator detail cross section, and the elevation of the wall.

The Board agreed to TABLE to another meeting for clarification.  All in favor.

AGENTS REPORT:

  • Rabid Racoon:  Bit someone who is now going through treatments.

OTHER BUSINESS:

  • Planning Board:  The Board of Health will read over the Draft Planning Board By-laws and submit their comments.

M. Ricker motioned to adjourn the Board of Health meeting.  M. Johnson seconded.  All in favor.
