CONSERVATION COMMISSION

Matthew Kennedy opened the meeting at 7:00 p.m. 

7:00 p.m    NOTICE OF INTENT   - DEP File # 183-571  HOWATT  - Lot E-1  Chapin Road –The public hearing was opened.  The Application is to construct a single family home, septic system and well within the 100’ buffer zone of a bordering vegetated wetland. 

 There is an intermittent stream and associated bordering vegetated wetlands located on the property, the natural topography created a clear delineation.    All flags and soil test locations were marked.  There were no questions from the Commission. Robert Lowell made a motion to close the public hearing, Kenneth Strom seconded the motion, all were in favor, 5-0.  Robert Lowell made a motion to issue a standard Order of Conditions with a special condition that a permanent demarcation be placed at the 25’ no disturb zone to prevent future intrusion, Michael Krikonis seconded the motion, all were in favor, 5-0.

DEPARTMENT OF PUBLIC WORKS – Newell Road Culvert Improvements – The Town of Holden is proposing to conduct drainage improvements on Newell Road.  The improvement area is located at the intersection of Cranbrook Drive and Newell Road.  Across the street from this intersection there is a low spot with a guardrail, on the north side of the guard rail there is a steep grade.  Runoff has been traveling over the steep slope and is undermining the roadway and guardrail.  The Town will be installing two new catch basins, replacing the guardrail, and stabilizing the slope with erosion control fabric and rip rap.  Ken Strom made a motion that the maintenance work presented to the Commission does not require the filing of Notice of Intent, Michael Scott seconded the motion, all were in favor, 5-0.  

EXTENSION OF TIME – Fisher Terrace   Fisher Terrace, LLC DEP File #183-459 The Applicant was asked to evaluate the required replication area, install erosion controls and conduct maintenance to the stormwater system prior to an extension of time being granted, no new information has been received.  Robert Lowell made a motion to grant an extension of the Order to May 1, 2013, Michael Scott seconded the motion all were in favor, 5-0.

DEPARTMENT OF CONSERVATION AND RECREATION  Reforestation Grant – The Town of Holden is being awarded $40,000 for the planting of shade trees on public property.  Mike Scott suggested contacting the Recreation Department to determine if shade trees were needed at the Dawson Pool. 

PARTIAL RELEASE OF ORDER – 117 Fox Hill Drive DEP File # 183-39

This property still has a covenant from the Order of Conditions that was issued for the Fox Hill subdivision, the lot is not jurisdictional under the Wetlands Protection Act and the owner has requested a partial release.  Robert Lowell made a motion to issue a partial Certificate of Compliance for 117 Fox Hill Drive, Michael Krikonis seconded the motion all were in favor, 5-0. 

PARTIAL RELEASE OF ORDER – 102 Sycamore Drive DEP File # 183-39 The Applicant withdrew the request for a partial release.

EXTENSIONS OF TIME – Wachusett Woods Subdivision and Lots 15-25  The Orders expire in April, 2013 and the Applicant has requested a two year extension.  Robert Lowell made a motion to grant a two year extension for the Order of Conditions, Michael Scott seconded the motion, all were in favor 5-0. 

CERTIFICATION OF COMPLIANCE Highlands of Holden (f.k.a. Deer Run)

Vista Circle The Department of Public Works is in the process of reviewing the as-builts and stormwater system, the item was continued to the May 1, 2013 meeting. 

AMENDMENT TO ORDER OF RESOURCE AREA DELINEATION - 143 Quinapoxet Street - Goddard Consulting, LLC - DEP File #183-570  An ORAD was issued at the February meeting, the Applicant has revised the wetland flagging based on the Conservation Commissions decision and requested the new flag locations be approved.  Only two revised copies of the plan and a cover letter were submitted as part of the amendment package.  The amended flag was not located in the correct area.  The Commission unanimously voted not to grant the amendment

APPROVAL OF MINUTES – There was not a quorum for approval of the March 6, 2013 minutes. 

The next meeting is scheduled for May 1, 2013

The April 3, 2013 meeting minutes were approved on May 1, 2013.
