R. Lowell called the meeting to order at 7:04PM.

 

REQUEST FOR DETERMINATION OF APPLICABILITY Domingo Tavarez- 56 Bryant Road- Assessing Map 70 Parcel 2 Septic upgrade and the installation of a new well – Mark Farrell- Green Hill Engineering

 

M. Farrell waived the reading of the Public Hearing Notice.

 

M. Farrell stated there was an existing single family home on Bryant Road built in the 40’s with an original septic system and overflow cesspool by the road and vegetative wetlands across the street. M. Farrell stated that the applicant wished to replace the cesspool with a Title V compliant system and a leach field.  M. Farrell showed the Commission the BZ line on the plans and stated that all the work would be done outside the buffer zone.  He stated the applicant was also proposing putting in a new well.  He stated the existing well had a bacteria problem and they wanted to abandon it and put a new well in the front yard.  He stated the leach field would be in the back corner.

 

M. Farrell stated that they would use straw wattles below the well drilling and they would also dig a small pit so the well drilling could irrigate the ground. He stated the soils were good (sand and gravel) and could take the water. 

 

M. Farrell stated that with regards to the cesspool, they would pump it and fill it with sand.  He stated this was located in the buffer zone.

 

R. Lowell asked if there were any other procedures for well abandonment.

 

M. Farrell stated that it would be left in for irrigation purposes.  He stated it was a homemade well and you can see where the surface water infiltrates so he did not believe there was any way to get the bacteria under control. 

 

R. Lowell asked if the new system would be fully buried and if they would take the existing system offsite.

 

M. Farrell confirmed they would.

 

G. Williamson stated the existing cesspool looked like dirt and rock.  She asked if there was a lot of digging involved for the new system.

 

M. Farrell replied there was not. 

 

G. Williamson asked for M. Farrell to show the Commission the property line. 

 

G. Williamson asked if there would be any tree removal.  M. Farrell replied there would not be.  

 

A Costello replied that it seemed uncomfortably tight.  He stated that he thought the previous owner had an additional lot towards the back. 

 

M. Farrell replied that he looked and there was nothing in the chain of title.  He stated that the land was bought as a foreclosure and that it showed this parcel but nothing behind it.  He stated he also looked at tax records and could find nothing additional to support putting a system on another parcel of land.  M. Farrell stated that this deed was for 100FT along the road and 68FT back and there was very little room to work with.

 

A Costello suggested speaking with the previous owners about clarification on the parcel.

 

P. Harding stated they were required to go by the registry.

 

M. Farrell stated that they would need to see who had the deed and then convey it to the new owners and he did not know if they wanted to do that.   He stated they would otherwise need to demonstrate that whoever was foreclosed on did actually own the additional lot. He stated that would be a complicated process and he did look into the deed and could not find anything that would indicate any deed on that back lot. 

 

L. Boucher asked if the tree in the back corner was being removed and how big it was.

 

M. Farrell replied it was roughly 12” and it was outside the buffer zone. 

 

P. Harding stated that she had advised the applicant to do an RDA.  

 

Motion by L. Boucher, seconded by A Costello, it was UNANIMOUSLY VOTED TO ISSUE A NEGATIVE DETERMINATION FOR THE RDA FOR 56 BRYANT ROAD- ASSESSING MAP 70 PARCEL 2, SEPTIC UPGRADE AND THE INSTALLATION OF A NEW WELL WITH THE UNDERSTANDING THAT EROSION CONTROLS OF STAKES AND STRAW WATTLES WOULD BE INSTALLED.

 

G. Williamson asked for the applicant to please contact the Town when the erosion controls were installed so they could come and look at them.

 

M. Farrell replied they would and there was a note on the plans to confirm this.

NOTICE OF INTENT- Summit Engineering- 1049 Princeton Street, Assessing Map and Parcel 36 (1-2 Portion Lot 10) Dave Brunelle Con’t

 

Andy Baum, Summit Engineering was present at the meeting.  He stated that he had sent in revised plans that added a rip rap on a common driveway and provided a little more detail on the replication area.  He stated they did soil boring at the limits of the proposed replication area as well that were shown on the last sheet of the plan.  A. Baum stated that the ground water was 14”-18”. He stated that they also did a detailed survey of the replication area along with some more detailed grading so that when they bring the cut along the replication area they should be in the water table. 

 

A Baum stated that the grading is pitched towards the road so any water seeping out will stay in the area.  He stated the intention was to give the replication area as many keys for success as they can. 

 

A Baum stated additionally they slid the septic system over a few feet based on an abutters comments.  He asked if the Commission had any further questions.

 

R. Lowell asked if there were any other questions. 

 

G. Williamson asked if the bank was altered.  A Baum replied the bank was not touched.

 

P. Harding replied it was not bank, it was BVW.

 

G. Williamson asked if the replication area was 1670.  A Baum replied that the last sheet is a table reflecting the areas.

 

R. Lowell asked if the square footage was the surface that was disturbed and if it was an estimate.

 

A Baum replied that it was and that they had some recorded information so this was their best attempt to come up with a value.

 

R. Lowell replied he appreciated the test pits.  He stated that it looked as though there were certainly wetlands and he is hopeful that it will take.

 

A Baum stated that there was also rick topsoil.

 

G. Williamson asked how far down they would be excavating.  A. Baum replied 18” in the corner.

 

R. Lowell asked if anyone from the public had any questions. No members of the public stepped forward. 

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO CLOSE THE PUBLIC HEARING FOR NOTICE OF INTENT- SUMMIT ENGINEERING, 1049 PRINCETON STREET, ASSESSING MAP AND PARCEL 36 (1-2 PORTION OF LOT 10) DAVE BRUNELLE.

 

G. Williamson asked about the percentage and time for the monitoring of the replication area.

 

A Baum replied that two years and 75% was indicated on the plan.

 

P. Harding replied they required three years to ensure that it lasts.

 

R. Lowell asked about the time frame. 

 

A Baum stated that he thinks they would be ready to build in the spring so it would behoove them to do the replication area right away.

 

G. Kiritsy stated that the replication area was not near the house so they could do both right away.

 

M. Scott stated that they have the 25FT buffer delineation but the plans show the tree line at 25FT as well.

 

P. Harding replied she did not think they needed boulders.

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO ISSSUE A STANDARD ORDER OF CONDITIONS FOR NOTICE OF INTENT/ SUMMIT ENGINEERING 1049 PRINCETON STREET, ASSESSING MAP AND PARCEL 36, DAVE BRUNELLE WITH AN ADDED CONDITION OF MONITORING THE REPLICATION AREA FOR THREE YEARS.

REQUEST FOR CERTIFICATE OF COMPLIANCE- #183-293 

Reed Rico Company/ Quamco Inc.  – 18 Industrial Drive- warehouse addition (Final Orders issued on January 12, 2000 Recorded in Book 22367, Page 199) and

REQUEST FOR CERTIFICATE OF COMPLIANCE- #183-242 Reed Rico Company/GZA- 18 Industrial Drive- test pits (Final Orders issued on December 18, 2997) and

REQUEST FOR CERTIFICATE OF COMPLIANCE - #183-505 Bradford Middlesworth-18 Industrial Drive Site Remediation (Final Orders issued on May 15, 2008). 

 

P. Harding stated that the work was completed on the above matters, however there was never a request for the certificate of compliances’.

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMOULY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCES’ FOR #183-293, #183-242, AND #183-505.

 

FISHER ROAD

 

G. Williamson stated that she had received some minor changes for the house located at Fisher Road.  She stated they wish to shift the leach field and they wanted more room for the lawn and to add a deck. 

 

P. Harding stated that this was the property that the Commission had previously approved with the common driveway on Fisher Road. 

 

G. Williamson stated that the distance from the wetlands was not 103FT, it was 111FT previously.

 

P. Harding stated he moved the location of the house as well.  She stated there were wetlands on both sides.

 

L. Boucher stated there was limited disturbance but if they kept it the same it did not appear significant.

 

R. Lowell agreed and stated that the change did not appear to be significant.

 

K. Strom entered the meeting at 7:33PM.

 

R. Lowell asked if any of the Commission had any concerns with the changes.  No members did.  He stated that it did not appear to be a significant change.

 

FOREST CUTTING PLAN CH 132

Lot 5265 Malden Street- MA DCR

 

G. Williamson stated that it was not a new plan but the forester commented on it. She stated that the date on the plan moved back one month and that he commented that there was no harvesting in the wetlands, keep landing area grater than 50FT, and mitigate with proper forest bmps.  She stated they also provided a better map. 

 

MACC- Sign on Opportunity

Letter from MACC to Governor Baker to oppose the construction of interstate pipelines.

 

R. Lowell asked if they wanted the Commission to review the matter. 

 

G. Williamson replied that they want the Commission to say that they do not want an interstate gas pipeline.

 

K. Strom stated he does not believe it impacts Holden. 

 

A Costello stated he was not in favor of the gas lines.

 

R. Lowell stated that the Commission had no interest in the matter at this point in time.

 

MACC Annual Environmental Conference- Saturday, March 4, 2017, College of Holy Cross

 

P. Harding stated that if anyone had interest in attending the conference to please send what sessions they would like to attend to her or G. Williamson and they would sign the Commission members up.

 

APPROVAL OF MINUTES

 

Motion by K. Strom, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO APPROVE THE DECEMBER 7, 2016 CONSERVATION COMMSION MEETING MINUTES AS AMENDED.

 

MISC

 

R. Lowell asked about Greenwood Estates.  P. Harding stated there was a meeting on February 2, 2017.  She stated they wan to meet with DEP before filing the MEPA.

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO ADJOURN THE FEBRUARY 1, 2017 CONSERVATION COMMISSION MEETING AT 7:51PM.
