M. Kennedy called the meeting to order at 7:00PM. 

 

AMENDMENT TO FISHER TERRACE PHASE I DEP File #183-459 Revised Layout  This is a continued item.  At the last meeting the Conservation Commission asked grading and associated changes be incorporated into revised plans.    The letter incorrectly stated that Unit 8 and 9 were moved, the plans only moved units 4-7.   

 

Matthew Kennedy asked if the Engineering calculated the change in the impervious area and how it would affect the stormwater calculations, the Engineer stated they had not.   The Engineer noted the fire lane was removed from the plans,  P. Harding stated the fire lane was required by the Fire Chief  during review of the original plan and it could not be removed.   

 

M. Kennedy asked how much closer units 4-7 were to the wetland, the applicant did not know.  He requested they look at the difference in the impervious area and evaluate the grading to determine how it will work with existing. 

 

Iqbal Ali, Crescent Builders stated that he wished to withdraw the request for an amendment and revert to the original design.  The Commission acknowledged his request, reminding the Applicant the existing Order of Conditions expires this September.

 

NOTICE OF INTENT  - OAK HILL SUBDIVISION – KENDALL HOMES

LOTS 19, 28, 29 and 40 JORDAN ROAD  Salisbury Street The hearings were opened simultaneously because the lots are all located within the Oak Hill Subdivision. 

 

The Applicant is proposing lots within the buffer zone of a BVW.  Scott Morrison presented the plan.  The wetland line was reviewed and approved during an ANRAD filing and this NOI was for  the construction of single family homes.  The proposed grading on the lots were relatively minor.  Lot 29 was proposed work within the 25’ no disturb zone.  The Commission requested the applicant look at alternatives to reduce the disturbance. 

 

Robert Lowell made a motion to close the hearings for lots 19, 28 and 40 and continue the public hearing for Lot 29 to the July 1, 2015 meeting.  R. Lowell also motioned to issue a standard Order of Conditions for Lot 19, 28 and 40.  The motion was seconded by Ken Strom and unanimously approved by a vote of 5-0. 

 

CERTIFICATE OF COMPLIANCE – 50 Chapin Road DEP File #183-274 - Leonard Anderson –  Leonard Anderson requested a Certificate of Compliance for an Order that was issued in 1999 for the construction of a single family home.  P. Harding Conducted a site inspection and reported the driveway was not constructed to plans, containing a loop with an island in the middle, however the width was reduced and the distance of pavement to the wetlands was not altered.

 

L. Anderson stated he had the changes reviewed at the time of construction by the Conservation Commission Agent Jim Morin.

 

 R. Lowell made a motion to issue a Certificate of Compliance.  M. Krikonis seconded the motion, there was unanimous vote 5-0 to issue the Certificate.   

 

CHAPTER 61A REQUEST FOR RELEASE – River Street, Riley LLC The Commission reviewed a request for release of property from Chapter 61A.  Agricultural Land for Lots 4, 5, 6 and 7.  The lots were created through a previously approved ANR, the property is in the R-40 zoning district with frontage on River Street.  The lots all have approximately 40,000 square feet of area.  The purchase and sale agreement is for $300,000.  The a larger parcel which was recently approved for a common driveway servicing two house lots, the larger parcels will remain in Chapter 61A.  Lots 4-7 contain steep grades, do not abut any protected open space and have not been identified as critical wildlife habitat.

 

M. Krikonis made a motion to not recommend purchasing the River Street parcels.  A. Costello seconded the motion; all were in favor, 5-0.

 

SALISBURY STREET – HOLBROOK PROPERTY Greater Worcester Land Trust – Grant Application – Conservation Restriction The Holden Conservation Commission was approached by the Greater Worcester Land Trust to write a letter of support for a grant application to the Executive Office of Environment and Energy to acquire Lot 5 of the Holbrook property located on Salisbury Street.  The property consists of approximately 23.91 acres of land and has frontage on Salisbury Street in Holden.

A portion of the Holbrook property was previously acquired by Greater Worcester Land Trust/White Oak Land Conservation Society and formed an open space corridor between Cook's Woods located in the Worcester on the Holden line, to land off Fisher Road and out to Camp Kinneywood, however there is no public access in Holden.

The preservation of Lot 5 will provide public access to this greenway corridor from Holden via frontage on Salisbury Street and preserve an additional 23.91 acres to the expansive greenway connection.  There is no cost incurred by the Town by supporting the application or accepting the restriction.   

 

 

 

AMENDMENT TO NOTICE OF INTENT NEWELL ROAD DEP FILE #183-576  There is an existing Order for the construction of two single family homes on Newell Road.  The Commission reviewed a revised plan entitled “Lot Development Plan, Newell Road” prepared by Quinn Engineering dated May 11, 2015, reducing the development  to one single family house lot within the approved area of disturbance.  R. Lowell made a motion to approve the amendment M. Krikonis seconded the motion, all were in favor, 5-0. 

 

CERTIFICATE OF COMPLIANCE 295 Bullard Street (Lot 38) DEP FILE#183-594.  The Applicant installed a fence the day of the meeting, the project was inspected earlier in the day and the yard was stabilized, the home was moved closer to the roadway and the width was increased but the distance to the wetland also increased, an as-built was presented to the Commission.  Robert Lowell made a motion to issue the Certificate of Compliance conditioned upon inspection and approval of a fence at the 25’ no disturb line, M. Krikonis seconded the motion, the motion passed unanimously, 5-0.

 

CERTIFICATE OF COMPLIANCE 175 Quinapoxet Street DEP FILE#183-597 The Applicant installed a fence the day of the meeting, the project was inspected earlier in the day and the yard was stabilized, and the home was constructed to plan.  Robert Lowell made a motion to issue the Certificate of Compliance condition upon inspection and approval of the fence at the 25’ no disturb line, M. Krikonis seconded the motion, the motion passed unanimously, 5-0.

 

APPROVAL OF MINUTES

 

Motion by M. Krikonis, seconded by K. Strom, it was UNANIMOSLY VOTED TO APPROVE THE JUNE 3, 2015 CONSERVATION COMMISSION MEETING MINUTES AS CORRECTED.

 

OTHER

 

Robert Lowell noted a new sign at Trout Brook in which the Conservation Commissions name was removed from the new sign, the Commissioners are owners of the property.   

 

Motion by K. Strom, seconded by A. Costello, it was UNANIMOUSLY VOTED TO ADJOURN THE JULY 1, 2015 CONSERVATION COMMISSION MEETING AT 9:16PM.
