The meeting was called to order at 7:01PM by R. Lowell

 

REQUEST FOR DETERMINTIATON OF APPLICABILTIY – Town of Holden Department of Public Works- Main Street Water Line Relocation

 

C. DeMoranville, DPW was present at the meeting.  He stated that what the Town wanted to do was to relocate the water main on Main Street and replace it.  He stated that the project would start at Shrewsbury Street and replace the water main to the Worcester City line.  He stated that they were in the buffer of the pond.  He stated that they would be using straw wattles on the edge of the work to keep the sediment out and all work was being done in the paved area.

 

R. Ricker asked what they were going to do with the existing line.  C. DeMoranville stated that the Town intended to keep the old line in service and abandon it once the new one was up and running.

 

C. DeMoranville stated that there was another small section where they will be in buffer zone near the Worcester line; Stepping Stone Drive.  He stated there was a small stream that runs through Stepping Stone and they will be connecting to existing lines and adding hydrants close to the stream.  He stated they will be using straw wattles for the work.

 

K. Strom asked where the resource area was.  P. Harding replied that it was added to the map later and showed him the location.

 

C. DeMoranville stated that the whole project was about 7,000 FT with the first section being about 900 FT. 

 

R. Lowell asked if they were borrowing fill and putting it back in the hole.  C. DeMoranville confirmed they were.

 

A Costello asked when they were going to do the project.  C. DeMoranville replied they were planning on doing it in the fall; September through November depending on coordinating with the contractor and bids.

 

R. Lowell asked what the anticipated schedule would be.  C. DeMoranville replied that they opened bid on July 28, 2016 and then they would need to work out the contracts.

 

R. Lowell asked what the specifications on repaving were.  C. DeMoranville replied that it would be up to the DOT permits; but that he thinks they have to pave once a week minimum.

 

Motion by K. Strom, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO ISSUE A NEGATIVE DETERMINATION OF APPLICABILITY FOR THE TOWN OF HOLDEN-DEPARTMENT OF PUBLIC WORKS- MAIN STREET WATER LINE RELOCATION WITH THE STIPULATIONS THAT WERE INDICATED ON THE PLAN AND SILT SACKS ADDED INTO THE CATCH BASINS ALONG THE ROAD.

 

ORDER OF CONDITIONS- Review of Drainage- Stoney Brook Estates

 

P. Harding stated that they had received revised plans today, June 29, 2016 and are with Graves Engineering for Peer Review.

 

The matter was continued to the August 3, 2016 Conservation Commission meeting.

 

NOTICE OF INTENT- Greenwood Estates DEP File #183-612 Jackson Woods Investments, LLC Union Street- Assessing Map and Parcels 132-95, 132-80, and 148-47

 

P. Harding stated that the revised plans were still under Peer Review by Quinn Engineering.

 

The matter was continued to the August 3, 2016 Conservation Commission meeting.

 

NOTICE OF INTENT – DEP FILE #183- Lot 7, 1055 Princeton Street and Lot 8, 1051 Princeton Street- Construction of Single Family Homes- David Brunell

 

P. Harding stated that this matter had been set for Peer Review with David Ross Associates.  She stated that she had met with Steve Sears in the field and they had made some minor alternations and that they were in agreement with the plans submitted.

 

Andy Baum, Summit Engineering was present at the meeting.  He stated that with regards to Lot 7 the wetlands were on the southerly side and based on the review there were no alterations to the line other than the minor changes to the wetland line.

 

A Baum showed the Commission the changes to Lot 8.  He stated that with the revisions, they shifted the septic slightly to remain outside the 100FT buffer zone.

 

Motion by M. Scott, seconded by K. Strom, it was UNANIMOUSLY VOTED TO CLOSE THE PUBLIC HEARING FOR NOTICE OF INTENT DEP FILE #183-LOT 7, 1055 PRINCETON STREET AND LOT 8 1051 PRINCETON STREET- CONSTRUCTION OF SINGLE FAMILY HOME DAVID BRUNELLE

 

M. Scott asked if they had spoken about delineation of the 25FT buffer zone.  A. Baum stated that they had spoken about it as part of the order of conditions. 

 

M. Scott asked if there was anything else from the Town.  P. Harding replied there was not.

 

R. Lowell asked if the property was wooded.  P. Harding replied it was a hay field and wooded.

 

A Baum stated that the woodland line is on the buffer zone. 

 

R. Ricker asked if the septic was in front.  A. Baum confirmed it was.

 

Motion by S. Scott, seconded by K. Strom, it was UNANIMOUSLY VOTED TO ISSUE A STANDARD ORDER OF CONDITIONS FOR LOT 7, 1055 PRINCETON STREET; CONSTRUCTION OF SINGLE FAMILY HOMES; DAVID BRUNELLEWITH THE ADDED PROVISION OF DEMARCATION ON THE 25 FT BUFFER ZONE.

NOTICE OF INTENT-GREENSTONE PROPERTIES WACHUSETT VALLEY ESTATES CONSTRUCTION OF SINGLE FAMILY HOMES LOT 11, 12, 13, 14 AND 17

 

Mark Popham, Greenstone Realty was present at the meeting.  He waived the reading of the Public Hearing Notice.

 

M. Popham reminded the Commission that they had requested that these 5 lots be broken apart into separate NOI’s.  He stated that it was required to do separate order of conditions for each house lot and Lots 11, 12, 13, 14, and 17 were identified.  He stated that under the approved subdivision plan all the utilities and roadways were presented to the Commission by Meisner Brem Associates and any plan that had detailed grading on the lots had also been resubmitted to the Commission. 

 

M. Popham stated that they had some interaction with the Planning Board regarding grading and elevations and drainage on Bullard Road but that most of these items did not involve any jurisdiction with Conservation.  He stated that Lots 11 and 12 originally were presented with a simple culvert of dug ditch and through the Peer Review process with Paul McManus it was determined that there was an intermittent brook.  P. McManus stated that this brook crossing should meet the Stream Crossing Standards and now the presentation from the developer accomplished that.  He stated that the driveway crossing with have a pre-manufactured concrete crossing structures for those driveways.  He stated that it will sit over the entire brook feature including the natural banks to accomplish the driveway crossing and it will replace the originally proposed culvert.

 

R. Lowell asked how that was embedded. 

 

M. Popham replied there was a stone bed on either side far enough off the bank that it doesn’t involve the bank.  He stated that as long as it was paved up to the approach and properly compacted the actual footings could sit on a stone base.

 

R. Lowell asked if there was grading up to it.  M. Popham replied that there was; he stated the site grade on the lots are not any different then in the culvert it just keeps the open area and reuses the fill within the buffer zone.

 

M. Popham stated that the other reason for the individual filing was that there was indication that it was easier for the Commission to condition the lots individually then they can all be issued a COC and there would be an easier transition when they were completed.  He stated that everyone had previously determined that it was beneficial to have separate orders filed.

 

R. Lowell asked if they were doing a guard rail or fencing because there was over a four foot drop.  M. Popham replied that there was nothing specifically planned yet but that there would be some interaction with the purchaser to determine how to move forward.

 

L. Boucher asked when they would be looking to construct these.  M. Popham replied that there had been active interest in the lots and there are good working conditions so the intention is to move forward fairly quickly.

 

L. Boucher stated that it was great weather right now when the water was not flowing.

 

M. Popham stated that everything was geared up and ready to get done. 

 

R. Lowell asked about stormwater management.  P. Harding replied that it was a two phase project; phase 1 is in and the sewer and pump station started construction.

 

M. Popham stated that Dave Getman, DCR had been there to look at the status of the work and that it is pretty well in place at this point. 

 

R. Lowell asked if the intermittent stream was currently flowing. M. Popham replied it was not.

 

M. Krikonis asked about the installation of the span.  M. Popham stated that it comes in on a crane in two pieced and it butts up against one another. 

 

M. Krikonis asked about the lifespan of the span.  M. Popham replied as long as concrete lasts.  He stated that there had been some discussion about doing some sort of seal but they were not sure if that was the best idea so there was a little interaction between the developer and the manufacturer regarding this.

 

NOTICE OF INTENT- Greenstone Properties Wachusett Valley Estates Lot 13

 

M. Popham stated that the proposed work for Lot 13 included clearing and grubbing with a 100FT buffer zone.  He stated that it was a 1,600 SQ FT dwelling with water and sewer and utility foundation and drain.  He stated that there was a proposed 750SQ FT bituminous concrete driveway and 500SQ FT buffer zone outside the no disturb area.

 

M. Popham stated that the clearing for the lots were previously fixed.

 

M. Popham stated that the plans had a line that the Commission didn’t like so he did a version that shows the buffer zone.  He stated that it is on record and what they did was change the plans to show the driveway crossing detail. 

 

R. Lowell asked if this was a walk out basement.  M. Popham replied it was pretty close; about 7-8FT high. 

 

R. Lowell asked if this was working with the minimum setback in the front.  P. Harding stated that it was.

 

R. Lowell asked if there was any public comment; no members of the public spoke.

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO CLOSE THE PUBLIC HEARING FOR NOTICE OF INTENT-GREENSONE PROPERTIES WACHUSETT VALLEY ESTATES LOT 13.

 

Motion by M. Scott, seconded by M. Krikonis, it was UNANIMOULSY VOTED TO ISSUE A STANDARD ORDER OF CONDITIONS PLUS ADDITIONAL CONDITIONS OF DEMARCATION OF THE REAR AND SUBMISSION OF PLAN SHOWING THE BUFFER ZONE AND EASEMENT FOR NOTICE OF INTENT-GREENSTONE PROPERTIES WACHUSETT VALLEY ESTATES LOT 13.

 

NOTICE OF INTENT- Greenstone Properties Wachusett Valley Estates Lot 14

 

M. Popham stated that the proposed work for Lot 14 included clearing and grubbing and regarding to clear a lot area and construction of an attached garage and rear deck.  He stated that it was a 1,2000 SQ FT dwelling with no work within the 25FT no disturb zone.

 

R. Lowell asked if the sewer easement was already in.  M. Popham replied that it was.

 

R. Lowell stated that it would be good to memorialize the wetlands to the right of way for the purpose of maintaining the sewer right of way.  He stated that they could do a boulder line at the right of way not to interfere with maintenance but so that people are aware that there are wetlands behind it.  He stated so instead of hugging the 25FT no disturb, they should hug the edge of the sewer easement.

 

M. Popham stated that rather than typical boulders that were used they had chippings that looked like stone walls; he asked if something along those lines could be used.  The Commission stated that it could.

 

R. Lowell asked for public comment; no members of the public stepped forward.

 

Motion by M. Scott, seconded by L. Boucher it was UNANIMOSLY VOTED TO CLOSE THE PUBLIC HEARING FOR NOTICE OF INTENT- GREENSTONE PROPERTIES WACHUSETT VALLEY ESTATES LOT 14.

Krikonis, it was UNANIMOUSLY VOTED TO ISSUE A STANDARD ORDER OF CONDITIONS PLUS ADDITIONAL CONDITIONS FOR DEMARCATION USING STONE ALONG THE EASEMENT LINE RATHER THAN THE 25FT NO DISTURB BOUNDARY AND SUBMISSION OF PLAN SHOWING THE BUFFER ZONE AND EASEMENT FOR NOTICE OF INTENT-GREENSTONE PROPERTIES, WACHUSETT VALLEY ESTATES LOT 14.

 

NOTICE OF INTENT- Greenstone Properties Wachusett Valley Estates Lot 17

 

M. Popham stated that for this lot there was about 100SQ FT of rear deck and some clearing and grubbing but that there was no work within the 25FT no disturb zone.  He stated that they felt that it should be filed but that there was not much on this lot.

 

P. Harding asked for a plan that showed the buffer and the wetlands. 

 

R. Lowell asked if there was any public comment; no members of the public stepped forward.

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO CLOSE THE PUBLIC HEARING FOR NOTICE OF INTENT; GREENSTONE PROPERTIES WACHUSETT VALLEY ESTATES LOT 17.

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO ISSUE A STANDARD ORDER OF CONDITIONS PLUS ADDITIONAL CONDITIONS FOR DEMARCATION USING STONE ALONG THE EASEMENT LINE RATHER THAN THE 25FT NO DISTURB BOUNDARY AND SUBMISSION OF PLAN SHOWING THE BUFFER ZONE AND EASEMENT FOR NOTICE OF INTENT-GREENSTONE PROPERTIES, WACHUSETT VALLEY ESTATES LOT 17.

 

NOTICE OF INTENT- Greenstone Properties Wachusett Valley Estates Lot 11

 

M. Popham stated that for this lot there was an institution for water and sewer underground foundation and construction of the concrete driveway plus 150SQ FT of deck and the driveway crossing that was discussed earlier.  He stated that there was no work within the 25FT no disturb zone.

 

R. Lowell asked if the only wetland on the lot was the intermittent stream.  P. Harding stated that the buffer was not shown on the plans.

 

M. Popham stated that the buffer was the buffer to the brook itself but not to the vegetative wetlands.  He stated that all work is outside the 100FT buffer zone.

 

L. Boucher asked about doing a test pit for the soil.  He stated that the manufacturer was going to propose some sort of footing and determining the capacity of the soil would be important.

 

M. Popham stated that there was interaction between the primary contractor and the manufacturer and they are working those details out.

 

L. Boucher stated that the excavation within 4FT of the intermittent stream would presumably be done in the dry season; he suggested putting in control barriers on both sides of the bank of straw wattles.

 

M. Popham stated that there was a stone check dam in place as well.

 

M. Scott stated that L. Boucher was talking about under the bridge during excavation (L. Boucher confirmed this was what he was talking about).

 

M. Popham stated that it could only be put in during the dry season.

 

L. Boucher suggested putting one straw wattle down on each side.  

 

R. Lowell asked if there were any questions from the public; no members from the public stepped forward.

Strom, it was UNANIMOUSLY VOTED TO ISSUE A STANDARD ORDER OF CONDITIONS PLUS ADDITIONAL CONDITIONS FOR PLACEMENT OF EROSION CONTROL BARRIERS ON THE INSIDE OF THE DITCH; CONSISTING OF A CORE LOG OR STRAW WATTLE, INSTALLED BETWEEN FOOTINGS AND THE TOP OF THE BANK DURING CONSTRUCTION AND FOR CONSTRUCTION TO TAKE PLACE DURING THE DRY PERIOD.  ADDITIONALLY FOR SUBMITAL OF A PLAN SHOWING THE BUFFER ZONE AND EASEMENT FOR NOTICE OF INTENT-GREENSTONE PROPERTIES, WACHUSETT VALLEY ESTATES LOT 11.

 

NOTICE OF INTENT- Greenstone Properties Wachusett Valley Estates Lot 12

 

M. Popham stated that work within the 100FT buffer zone to the vegetative wetlands included clearing and grubbing.  He stated there was 1,800 SQ FT of attached garage, water, sewer underground utilities and construction of 2,300 SQ FT of impervious area with the bituminous driveway.  He stated that there was no work being done within the 25 FT wetlands and that there was the same driveway stream crossing structure that was describe for Lot 11.

 

L. Boucher stated that it looked like everything was already shifted on this lot and that the structure could not move any further away from the 25FT no disturb zone. 

 

M. Scott stated that the sewer service was crossing through the channel.

 

M. Popham stated that the utilities were going under the channel and they were both using gravity

 

R. Lowell asked if there was adequate cover at the bottom of the ditch.  M. Popham replied that there was.

 

K. Strom asked if it was all gravity.  M. Popham confirmed it was. 

 

P. Harding asked where the water line was.  M. Popham showed her.

 

R. Lowell opened the hearing up for public comment; no members of the public spoke.

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMSOLY VOTED TO CLOSE THE PUBLIC HEARING FOR NOTICE OF INTENET, GREENSTONE PROPERTIES, WACHUSETT VALLEY ESTATES LOT 12.

 

Motion by M. Scott, seconded by L. REQUEST FOR CERTFICIATE OF COMPLIANCE the Seasons at Salisbury DEP File # 183-316

 

P. Harding stated that they had provided the Town with an as built and everything seemed fine.

 

Motion by M. Krikonis, seconded by K. Strom, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE TO THE SEASONS AT SALISBURY DEP FILE # 183-316.

 

REQUEST FOR A DETERMINATION OF APPLICABILITY- Providence and Worcester Right of Way- Vegetation Management

 

P. Harding stated that they received a superseding order on this matter from DEP.

 

REQUEST FOR CERTIFICTE OF COMPLIANCE- DEP 183-576 30 Newell Road- Jardus/ Greenstone Realty, LLC

 

P. Harding stated that this was completed.  She stated that everything stabilized and has grown in.

 

Motion by M. Krikonis, seconded by K. Strom, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE FOR 30 NEWELL ROAD JARDUS/ GREENSTONE REALTY, LLC.

 

REQUEST FOR CERTIFICATE OF COMPLANCE- DEP File 183-500 Reservoir Street- Drawbridge  /Greenstone Realty. LLC

 

R. Lowell asked if this work was done satisfactorily.  P. Harding replied that it was not really done according to the plan but that it was done and stabilized.  The Board held off on issuing the Certificate of Compliance until she was able to provide pictures to the Board.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- Town Bylaw Lot 4 Chapin Road- LAM Builders.

 

P. Harding stated that this was an order of conditions issued under local bylaws.  She stated that an abutter bought Lot 4 and never built on it and now they are selling Lot 4 to the other abutter who also does not intend to build on it.  They are requesting a Certificate of Compliance with no work.

 

Motion by L. Boucher, seconded by M. Scott, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE FOR TOWN BYLAW LOT 4 CHAPIN ROAD-LAM BUILDERS.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE-DEP File #183-359 2449 Main Street

 

Motion by M. Krikonis, seconded by K. Strom, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE FOR DEP FILE #183-359 2449 MAIN STREET.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- DEP File #183-489 480 Manning Street- Haldey Installation of Septic System

 

P. Harding stated this was a replacement of septic within a buffer zone and it was completed and is fine.

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE FOR DEP FILE # 183-489 480 MANNING STREET HADLEY INSTALLATION OF SEPTIC SYSTEM.

 

RESIGNING OF EXTENSION OF TIME- Chapin Road Lots 1 and 2

 

The Commission resigned the necessary documents.

 

APPROVAL OF MINUTES

 

Motion by L. Boucher, seconded by A. Costello, it was VOTED TO APPROVE THE JUNE 1, 2016 CONSERVATION COMMISSION MEETING MINUTES AS CORRECTED.

 

Motion by M. Scott, seconded by M. Krikonis, it was UNANIMOUSLY VOTED TO ADJOURN THE JUNE 29, 2016 CONSERVATION COMMISSION MEETING AT 8:26PM.
