Matthew Kennedy opened the meeting at 7:00 PM

 

DEPARTMENT OF CONSERVATION AND RECREATION – Stormwater Improvements Unionville Pond.  The Department of Conservation Recreation will check the Massachusetts Department of Transportation guidelines on slopes adjacent to roadways in order for improvement of existing conditions to be made, likely with fill.  Matthew Kennedy asked how the rip rap was sized, no hydraulic calculations were completed and the rip rap was meant to improve existing conditions, Matthew Kennedy was concerned if the area was overloaded it could increase the erosion control issues, he suggested the applicant file a Notice of Intent. The Department of Public Works are scheduled to pave surrounding streets within the next one to two months; DCR to coordinate storm-water improvements with the town paving schedule.

 

NOTICE OF INTENT – Fisher Terrace; Phase II – Fisher Terrace Phase II

Construction of 12 additional condominium units.  Continued to the next Conservation Commission meeting scheduled August, 6, 2014.

 

NOTICE OF INTENT – 32 Erin’s Way – DEP File #183-589

Construction of a garage – John and Kathy Gould – assigned to Michael Scott

Detached garage access to rear of single family home results in 12’ driveway; work is within the buffer zone; the drainage easement will be relocated through the Planning Board.  Standard order issued for boulders to be placed at 25’ demarcation line.  Matthew Kennedy made a motion to close the hearing, Michael Scott seconded the motion—all (6-0) in favor.

 

NOTICE OF INTENT – 664 Lot 4 B Bullard Street

Wingspan Properties – Construction of a single family home and septic system; assigned to Kenneth Strom, who walked the property on July 1, 2014.  Existing single lot with two family homes; 1 is a 2 bedroom dwelling, the second a cottage—subdivided.  Septic system installed.  Variance lot frontage,

variance lot area-Board of Health approved and Zoning approved.  Septic system is out of buffer zone but the home and grading of the rear yard are jurisdictional.  Michael Scott motioned to close the hearing, Kenneth Strom seconded the motion—all (6-0) in favor.

 

Kenneth Strom indicated that he observed work at the back of dwelling where new loam was laid on the abutting lot—lawn was historically up to an old patio wall.  Separate issue from this filing and they would address the violation separately.  Michael Scott made a motion to issue a standard Order of Conditions with the Condition a permanent demarcation be placed at the current limit of clearing or the 25’ demarcation, Kenneth Strom seconded the motion—all (6-0) in favor.

 

ABBREVIATED NOTICE OF INTENT – Lot 4A Rondeau Road

Eagleville Realty, LLS – Construction of driveway and septic for single family home – Assigned to Anthony Costello.  Parcel 42; abutting wetlands.  The Applicant indicated he will be relocating the reserve area for the septic system out of the 100’ buffer zone.  The Applicant must revise plan and show clearing; applicant must also show driveway grading away from wetlands.  Applicant must present to Board of Health and Planning Board.  Have revised plans stamped.  Michael Scott motioned to continue this hearing to the next Conservation Commission meeting scheduled August 6, 2014.  Anthony Costello seconded the motion—all (6-0) in favor.

 

NOTICE OF INTENT – 525 MAIN STREET – TONI MANDEL

Proposed addition to a commercial property – assigned to Luke Boucher.  Continued to the next Conservation Commission meeting scheduled August 6, 2014 at the request of the Applicant.

 

NOTICE OF INTENT -- 385 Salisbury Street – Wingspan Properties, LLC

Construction of single family home – assigned to Michael Krikonis.  Proposed driveway will be raised over a culvert which may or may not create a dam effect.  Holly Shaughnessy, 339 Salisbury Street expressed concern about the slope and water runoff entering her yard from the site.  Skip Marconi, Putnam Lane citizens expressed concerns about water table rising in nearby Chaffins’ Pond and water running into Putnam Lane and surrounding wetland areas; Commission indicates that this should not be a concern because spill-off water is going into the same areas.   The Commission was concerned about a damming effect and point discharge being created from the pipe.   Michael Krikonis motioned to close the hearing, Michael Scott seconded the motion—all (6-0) in favor.  Michael Scott made a motion to issue Standard Order of Conditions with special conditions requiring a boulder demarcation line at limit of work between flags 20-22 and 31-33, all slopes 3 to 1 or greater will require temporary slope stabilization. 

 

NOTICE OF INTENT – 325 Bullard Street – Lot 38 Greenstone Properties, LLC

Construction of single family home – assigned to Rob Lowell.  A wooded swamp exists on this property.  Water and sewer lines on close side of Bullard Street; lot is fully wooded.  Pamela indicated that Rob Lowell conducted a site visit but he could not locate a plot plan.  Public citizen raised concern about water spill off freezing in winter months.  Greenstone Properties representative states that he is confident drainage will work, plans are for a short drainage system.  Wetland area continues to drop, water elevation conservative; on an upslope from lower flood area filled with mature trees.  Construction schedule begins upon approval.  Michael Scott motioned to close the hearing, Kenneth Strom seconded the motion—all (6-0) in favor.  Michael Scott made a motion to issue a Standard Order of Conditions with the Special Condition that a permanent demarcation be utilized for Wetland Flag 1-4 and filter bags be installed in the catch basin at either side of driveway, at the discretion of the Department of Public Works, Kenneth Strom seconded the motion—all (6-0) in favor

 

NOTICE OF INTENT – Wachusett Valley Estate – 325 Bullard Street 36 Lot Subdivision, Greenstone Properties, LLC Assigned to Commission.  48 acre site; Freedom Lane within development 580’ roadway; basin, pipe drainage against wetland; a portion of site within wetlands area, the Commission questioned the presence of a vernal pool on the property and informed the Applicant peer review is required.  A detention area is located within 100’ of a Zone A water resource and must be relocated.  To receive credit for a extended detention basin there must be a provision for drawdown, the basin must have an orifice for drawdown.  bowl for culvert water drainage not ideal.  Make suitable area for drainage.  Matthew Kennedy required to the applicant to relocate the emergency spillway for the detention area out of fill into natural ground.  The Commission questions the Applicant allocating a 45% TSS removal for discharging to 50’ of area.  Wetland areas peer reviewed to be paid for by Greenstone Properties.  Residents in attendance voiced concerns ranging from Box Turtles and Frogs to wetlands and water buildup.  Conservation Commission response:  The Applicant filed the plans and received approval from the  National Heritage with a condition that a turtle barrier be utilized, peer review will be required to determine if a vernal pool is located on the property.  Storm drainage requirements: will be reviewed by CEI or Graves Engineering to ensure all plans meet required standards and downstream areas are not overwhelmed.  Matthew Kennedy motioned to continue the hearing to the September 3, 2014 Conservation Commission meeting, Michael Scott seconded the motion—all (6-0) in favor.

 

CERTIFICATE OF COMPLIANCE  – Quinapoxet Street, Jefferson Meadows, LLC DEP File #183-547.  Continued to the next Conservation Commission meeting scheduled August, 6, 2014.

 

NOTICE:  DEP File #183-336 410 Bailey Road – Nielson Pond application of Aquatic Herbicide.  Notice of the annual herbicide application was received by Anchor Neilson, the Order expires in 2016.

 

270 Shrewsbury Street – DEP File #183-578 – Mt. View Middle School Construction – Minor Violation  Pam Harding conducted site walk with contractor and reports erosion control issues.  There was a minimal over cutting in a wetland at one corner.  Since this time as a result of the heavy thunderstorm which occurred on July 15, 2014 the site heavily eroded and silt entered a wetland system.  The Contractor was having a wetland scientist evaluate the impact and was instructed to create a temporary erosion control plan to address various phases of construction. .
