Meeting Called to order by M. Kennedy at 7:05pm

 

NOTICE OF INTENT- Wachusett Valley Estates, Greenstone Properties, LLC-36 Lot Subdivision

 

M. Kennedy stated that there was a quorum for the meeting. 

 

Paul McManus, EcoTec. Inc., reviewed the presence of the tributary, in addition to this, Bruce Bourk, DEP Hydro-geologist with the Drinking Water Supply program conducted a site visit and amended the DEP Zone A map to remove the designation off the subdivision property. 

 

Mr. Mark Popham, Applicants wetland scientist was present at the meeting.  He told the Commission that the inspection had been completed and it was determined by the DEP that the portion of the property in question was not considered Zone A.  M. Popham also told A. Costello that Meisner Brem Corporation completed an drainage evaluation on the center area that he was interested in and it was submitted to P. Harding. 

 

M. Popham reminded the Commission of the last meeting when they discussed the development of the 4 lots and the culverts in the driveways; the Commission had requested to handle each of these lots as separate notice of intents once they were created, the applicant agreed to do so.   He stated that they would like a continuation to address the subdivision roadways.

 

M. Kennedy asked how they were handled in the original notice of intent.  P. Harding replied that they were not included.  

 

M. Kennedy asked P. McManus if he had anything to add.

 

P. McManus explained the review of the Wetland for Zone A Tributary for the Wachusett Valley Estates.  He stated that the applicant had made contact with Mariel Stone from the DEP in Worcester.  She contacted DEP in Boston and they sent out Mr. Bruce Bourke,

DEP Hydrogeologist with the Drinking Water Supply Program, to review the property to look for a definite channel.  

 

P. McManus told the Commission he was asked to reference a “bank,” more specifically that a bank existed and needed to be continuous to the reservoir in order to be considered a Zone A. 

 

P. McManus stated that he did review the water shed analysis relative to the bog wetlands; he stated that he thought the analysis was not perfect in that there was a portion of the watershed in the predevelopment plans that does not contain all the contributing area, the pre  and post development for undisturbed area are different and clarification was requested.   the back (the predevelopment) that goes further back in the area. He stated that he thinks the numbers are not as balanced as they could be. 

 

M. Kennedy asked for clarification.  P. McManus showed the Commission the map.  He showed where the predevelopment and post development water shed delineations were.  He showed where the high point post was and stated that the predevelopment did not do the same. 

 

M. Kennedy asked why this happened.  P. McManus showed the direction that the water should be moving in.  M. Kennedy asked if something was happening.  P. McManus stated that if the water was getting there post development it had to be getting there predevelopment as well.  M. Kennedy asked if the developer underestimated the existing drainage area and if the developer was looking at volume.

 

M. Popum replied that he was looking at volume in half year storms; the engineer (J. Brem) felt in terms of the hydrology of the wetlands, the big storms were not that important. 

 

M. Kennedy replied that he would like to see a water budget that is not just the one year storm but an average year’s waterfall.

 

P. McManus replied that they were not relying on the impervious area; they were relying on the ridge line on the houses.  He stated that he was going to comment that the hydrology of the wetlands be maintained as long as the water shed boundary continued.  He stated that it would be important to continue throughout the middle of all the houses and have a final grading water shed divide that everything goes back and drains to the rear. 

 

M. Kennedy asked if the one year was the right way to do the water shed.  He stated he would do a water budget accounting for the storage as well.  P. McManus replied that it was up to the Commission how it was conducted.

 

M. Kennedy stated that the developer needed to rectify that.  He asked how they dealt with the roof.   He looked at P. McManus’ plans and stated he wanted to see the water shed area correctly and that he would prefer to see water shed and how the developer dealt with the impervious area. 

 

M. Kennedy asked if there were any questions from the public.  No questions were asked from the public. 

 

M. Kennedy stated that the matter was continued until December 3, 2014.  He asked M. Popham if the thought they would have all pertinent information submitted in time for review. 

 

M. Popum replied yes.

 

P. Harding asked if the Commission would like Mr. Mike Andrade present for the next meeting.  The Commission replied they would.

 

Motion by R. Lowell, seconded by M. Krikonis, it was UNANIMOSLY VOTED TO CONTINUE THE NOTICE OF INTENT FOR WACHUSETT VALLEY ESTATES, GREENSTONE PROPERTIES, LLC, 36 LOT SUBDIVISION UNTIL DECEMBER 3, 2014.

 

NOTICE OF INTENT- Fisher Terrace Phase II-Fisher Terrace Phase II, Construction of 12 additional condominium units

 

Mr. Iqbal Ali, Fisher Terrace and Mr. Glen Krevosky, EBT Environmental were present.  G. Krevosky stated that the plans were finished yesterday (November 4, 2014) but they didn’t want the Commission to review until they were granted an extension of time. 

 

Motion by A. Costello, seconded by R. Lowell, it was UNANIMOUSLY VOTED TO GRANT FISHER TERRACE PHASE II, CONSTRUCTION OF 12 ADDITIONAL CONDOMINIUM UNITS AN EXTENSION.

 

EXTENSION OF TIME- FISHER TERRACE PHASE I

 

P. Harding told the Commission that Phil Nadeau submitted an opinion the Order for Fisher Terrace, could be extended under the original request for a time to be determined by the Commission.

 

G. Krevosky told the Commission that Mr. Nadeau’s comments were referring to the fact that the original extension did not have a time period on it.

 

M. Kennedy read the letter. He asked P. Harding what they did.  P. Harding replied that they had originally given a year that expired September 16, 2014.

 

M. Kennedy asked the Commission’s opinion.  R. Lowell replied that the concern was that things were not being completed.  M. Kennedy asked if additional work had been completed and how it looked.

 

P. Harding responded that it looked okay.  The developer took care of the ponds last year.

 

G. Krevosky replied that as per the Commission’s request, they did the maintenance on the detention structures, mowed, and stabilized the site.

 

M. Kennedy asked what remained to be done.  I. Ali responded that there were 5 additional foundations to do.

 

G. Krevosky asked I. Ali how many had been completed in the last year.  I. Ali responded that they had completed 4 buildings in the last year.  

 

R. Lowell asked from a construction point of view, how long it would take to complete.  I. Ali responded next spring (Spring 2015) for Phase I. 

 

M. Kennedy asked if they were happy with the original order of conditions.  P. Harding replied that nothing needed to change.

 

Motion by R. Lowell, seconded by M. Krikonis, it was UNANIMOUSLY VOTED TO APPROVE AN EXTENSION OF TIME FOR FISHER TERRACE PHASE I FOR A PERIOD OF 1 YEAR FROM SEPTEMBER 12, 2014 TO SEPTEMBER 12, 2015.

 

CERTIFICATE OF COMPLIANCE- DEP FILE # 183-341, 700 Main Street, Expansion of parking area.

 

P. Harding told the Commission that the location was Mexicali restaurant.  She stated the site was stabilized and that DCR issued a certificate of compliance. 

 

Motion by R. Lowell, seconded by M. Krikonis, it was UNANIMOUSLY VOTED TO ISSUE A CERTIFICATE OF COMPLIANCE FOR 700 MAIN STREET, MEXICALI.

P. Harding told the Commission that there was a 25 FT barrier and they did a post and beam fence.  She stated they put cedar wood in concrete so it was about 16” high, but it was permanent.   She stated they did that with lot 3 and 4.

 

Motion by M. Krikonis, seconded by A. Costello, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE FOR DEP FILE # 183-554 LOT 3 AND DEP FILE #183-557 LOT 4.

 

P. Harding stated that Lot 5 was not installed and Lot 6 had some grading issues.

 

RESIGNING CERTIFICATE OF COMPLIANCE- DEP File #183-382 Sewer Main Installation Wachusett Street between Lincoln and Malden C. B. Blair Development, Corp. Request for determination of Applicability- Putnam Lane- N Star

 

Motion by R. Lowell, seconded by M. Krikonis, it was UNANIMOUSLY VOTED TO APPROVE THE CERTIFICATE OF COMPLIANCE FOR DEP FILE #183-382 SEWER MAIN INSTALLATION WACHUSETT STREET BETWEEN LINCOLN AND MALDEN

 

The Commission resigned the certificate of compliance. 

 

Meeting Minutes

 

M. Kennedy stated that the Meeting Minutes could not be voted on due to not having a quorum. 

 

Other Business

 

M. Kennedy asked if there was any movement in cleaning up some of the outstanding work.  P. Harding replied that it was a matter of contacting and requesting certificates, she stated there were lots of field inspections needed and that they were waiting for the system (peoples gis).

 

Motion by M. Krikonis, seconded by R. Lowell, it was UNANIMOUSLY VOTED TO ADJOURN THE NOVEMBER 5, 2014 CONSERVATION COMMISSION MEETING AT 7:43PM.
