MINUTES

August 1, 2018

 

 

Members Present: Michael Scott, Anthony Costello, Kenneth Strom, Luke Boucher, Cathy Doherty

Members Not Present: Rob Lowell, David Nyman

 

K. Strom called the meeting to order at 7:03PM

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- 183-638- Assessing Map 102, Parcel 2. 159 Quinapoxet Street, Jim Harrity.  Single-family home and driveway.

 

G. Williamson stated that this was the home at the end of the street on the right. She stated that it was stabilized and looks good and there were boulders behind the house.

 

K. Strom stated that it was pretty straight forward. 

 

Motion by L. Boucher, seconded by C. Doherty, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE FOR 183-638 ASSESSING MAP 102, PARCEL 2, 159 QUINAPOXET STREET.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- 183-617.  Assessing Map 98, Parcel 41.  1845 Main Street (Lot 4B Rondeau Rd) Greenstone Realty.  Single Family home and driveway.

 

K. Strom asked if this home fronted Main Street.

 

G. Williamson stated that it was but that these houses were on Rondeau. She stated that the property was stabilized and people are living there now.

 

Motion by M. Scott, seconded by L. Boucher, it was UNANIMOUSLY VOTED TO ISSUE A CERTIFICATE OF COMPLIANCE FOR 183-617, ASSESSING MAP 98, PARCEL 41, 1845 MAIN STREET.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- 183-627.  Assessing Map 164, Parcel 30.  Lot 11, 82 Liberty Circle, Wachusett Woods/ Greenstone Realty.  Single-family home and driveway.  Final as-builts submitted.

 

G. Williamson stated that these lots were at the end of Liberty where the bridges needed to be put in.  She stated that they brought in the driveway culverts and they look really good.  She asked if there were any restrictions on the irrigation system in terms of if irrigation pipe could be put into the wetlands.

 

L. Boucher stated that it would disturb the wetlands if they did that.

 

G. Williamson stated that she did tell them that.

 

Motion by C. Doherty, seconded by M. Scott, it was UNANIMOUSLY VOTED TO ISSUE A CERTIFICATE OF COMPLIANCE FOR 183-627 ASSESSORS MAP 164, PARCEL 30, LOT 11, 82 LIBERTY CIRCLE.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- 183-628   Assessors Map 164, Parcel 31.  Lot 12, 80 Liberty Circle, Wachusett Woods/ Greenstone Realty.  Single Family home and driveway. 

 

G. Williamson stated that this lot was stabilized.   She stated that they called and wanted to remove the erosion control barrier but that she had told them to hold off until they received the Certificate of Compliance.

 

Motion by M. Scott, seconded by A. Costello, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE FOR 183-628, ASSESSORS MAP 164, PARCEL 31, 80 LIBERTY CIRCLE.

 

REQUEST FOR CERTIFCATE OF COMPLIANCE- 183-629 Assessors Map 164, Parcel 32, Lot 13, 74 Liberty Circle, Wachusett Woods/ Greenstone Realty  Single Family home and driveway.

 

G. Williamson stated that if you are facing the home on the cul de sac the easement runs on the left side of the house and it looks stable. 

 

Motion by L. Boucher, seconded by C. Doherty, it was UNANIMOUSLY VOTED TO APPROVE THE CERTIFICATE OF COMPLIANCE FOR 183-629, ASSESSORS MAP 164, PARCEL 32, 74 LIBERTY CIRCLE.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE 183-629 Assessors Map 220, Parcel 39.  Lot 2, 117 Chapin Road, Single-family home, driveway and septic.  Gordy Olin for Tom O’Shea. Final As-Built provided.

 

G. Williamson stated that the septic mound blocks the front of the house.  She stated that this property was stabilized and that they have the final as-built.

 

Motion by C. Doherty, seconded by A. Costello, it was UNANIMOUSLY VOTED TO ISSUE THE CERTIFICATE OF COMPLIANCE TO 183-563, MAP 220, PAREL 39, LOT 2, 117 CHAPIN ROAD.

 

REQUEST FOR CERTIFICATE OF COMPLIANCE- 183-563. Assessors map 220, Parcel 39.  Lot 1, 119 Chapin Road. Single-family home, septic, driveway crossing and replication area Gordy Olin, Final As-Built provided.

 

K. Strom asked if this was the one with the ambulance turnaround.

 

G. Williamson stated that she did not think this was ready with the replication area.  She stated that the shrubs have not had time to naturalize and it was not seeded.

 

K. Strom asked if the other one had a replication area.

 

G. Williamson replied that it did not.  She stated that she did not think that they normally signed off on a COC in the first season.  She showed the Commission the replication area but that she felt that it was not quite ready.

 

L. Boucher stated that he did not think they should issue one if the replication area was not complete.  He stated that they only had one chance to get this right.  He asked how long ago this was planted. 

 

G. Williamson replied last fall and it was under water until a few months ago.

 

K. Strom stated that it was not at the low point and that they would need to get the water up the driveway.

 

G. Williamson stated that the developer said that they had the hydrology in there but it did not have time to grow. She suggested revisiting this in the spring when it had more time to grow.

 

K. Strom stated that he thought it was a fail.  

 

M. Scott asked if they did topography to see if the land was flat.

 

G. Williamson stated that they had indicated that it was seeded with the wetlands mix.  

 

L. Boucher stated that it was up to them to get it right.

 

M. Scott asked who the wetlands person on this was.

 

G. Williamson stated that Burton did the replication; she stated that they mulched the whole thing in October 2017.

 

M. Scott asked if the Town had been out there recently.

 

G. Williamson replied that she was out there July 17.

 

A. Costello asked when they seeded.

 

G. Williamson replied last fall in 2017.  She stated that she would place a call to them.  She asked if they could take the erosion controls out along the lawn and if he should leave the erosion controls around the replication area.

 

M. Scott asked where it was sloping. 

 

L. Boucher stated that it looked like it was keeping the water out.

 

G. Williamson asked if he could take the silt fence off the back of the replication area.

 

L. Boucher stated that as long as the area above it was developed and that there wouldn’t be anything washing down through the replication area into the wetlands. He stated that if that was the case it may help the replication area.

 

K. Strom suggested that they have him remove the silt fence and that the Commission could revisit it.

 

L. Boucher stated that he wouldn’t tell them what to do.  He stated that he would say that they could try for more water but that he would prefer them to get direction from the people that they hired, not the Commission. 

 

G. Williamson stated that she would call the developer.

 

The Commission continued the matter until spring or until the developer believed the matter was resolved.

 

ENFORCEMENT ORDER- Holden / Rutland Line

 

G. Williamson stated that she went out again and there were different people there.  She stated that they did the erosion controls and that it was naturally vegetating.  She stated that they moved the debris away from the wetland and that she does not know if there is much more that can be done at this point.

 

K. Strom asked how they lifted the order.

 

G. Williamson stated that J. Votruba did the wetlands delineation and the wetlands were flagged.

 

K. Strom suggested issuing a letter that indicated that they and followed the directives of the Enforcement Order and that the Commission was satisfied at this time.

 

M. Scott stated that it seemed as though they had made an effort at this point.

 

The Commission directed G. Williamson to issue a letter.

 

 

DISCUSSION

 

38 Vista Circle- Beverly Goodell- Retaining Wall

 

G. Williamson stated that there was nothing new on this matter.

 

Dewatering Kendall Reservoir

 

G. Williamson stated that there were haybales and silt that washed into the reservoir.  She stated that they had new bags and were out there with brooms and boats to rake out the debris.  She stated that they were doing tests on the water but that there was not a lot of sediment in the reservoir.

 

K. Strom stated that it looked as though they captured a lot of it.

 

G. Williamson stated that they had boats in there and had replaced the silt fence and added a double row of hay bales.

 

L. Boucher asked if they were exceeding the capacity of the sediment bags.

 

G. Williamson stated that they did not know there was that much dewatering and they kept pumping.  She stated that they were running into a lot of rock as well and had 10 more feet of rock just to get in so they bought in a dewatering tank.  She stated that they would pump the tanks and then into the bag after so it will flow through.

 

L. Boucher asked if the pumps can keep up.

 

G. Williamson stated that all the run off cane from up the hill.

 

K. Strom stated that they should divert it.

 

G. Williamson stated that they still had ten more feet.  She stated that they were still about 3 weeks away from installing the first tank and they hit a rocky edge.  She stated that they had not figured in for the cost of a dewatering tank.

 

G. Williamson replied that they had another filter bag and they were still digging.  She stated that there was not much they could do and that they were still doing the tests.

Motion by L. Boucher, seconded by M. Scott, it was VOTED TO APPROVE THE APRIL 4, 2018 CONSERVATION COMMISSION MEETING MINUTES AS CORRECTED BY A VOTE OF 4-0-1 (C. Doherty: abstain).

 

Motion by L. Boucher, seconded by C. Doherty, it was UNANIMOUSLY VOTED TO APPROVE THE MAY 9, 2018 CONSERVATION COMMISSION MEETING MINUTES AS CORRETED.

 

Motion by L. Boucher, seconded by M. Scott, it was UNANIMOUSLY VOTED TO ADJOURN THE AUGUST 1, 2018 CONSERVATION COMMISSION MEETING AT 8:03PM.
