ZONING BOARD OF APPEALS

HEARING

 

KYOTO OF HOLDEN                                                                                     CASE NO. SP 1408

The Zoning Board of Appeals held a public hearing on July 24, 2014 at 7:15 p.m. in Memorial Hall in the Town Hall, 1196 Main Street, Holden, MA on the Application of Kyoto of Holden for property located at 695 Main Street for a SPECIAL PERMIT for the construction and operation of a restaurant serving food and alcoholic beverages.                             

 

Members in attendance:  R. Spakauskas, R. Fraser, J. Deignan and R. Butler.

 

The Chairman called the hearing to order.  The secretary read the Application, Findings of Fact and two letters pertaining to the case.

 

Attorney Brian Forts, representing the applicant, addressed the Board.  His client would like to open a Japanese restaurant with 52 seats and 14 parking spaces.  The area has 3 or 4 other restaurants.  The owners are experienced restauranteurs and have two other restaurants, one in Worcester and one in Northbridge.  The applicants will also be filing a Site Plan Review Special Permit with the Planning Board because this is a change in use and will also address the Board of Selectmen for their liquor license.

 

R. Spakauskas asked about signage.  Atty. Forts said there is a current ladder sign and his clients will be not asking for anything other than what the bylaw allows.

 

Both J. Deignan and R. Fraser expressed concern about what type of conditions the Planning Board would impose.  R. Fraser suggested this hearing be continued until the Board’s next schedule meeting, which is September 4th.

 

R. Butler did not think the Board should make the applicants wait until there is another Zoning Board meeting.

 

Since there were no further comments or questions, the public hearing was closed at 7:20 p.m.

 

The Board voted unanimously to grant the variance with the following condition:  1)  The use of the restaurant is approved subject to Planning Board approval of the Site Plan Review Special Permit.
