EDWARD LEAHY                                                                            CASE #1406

 

The Zoning Board of Appeals held a public hearing on June 19, 2014 at 7:15 p.m. in Memorial Hall in the Town Hall, 1196 Main Street, Holden, MA on the Petition of Edward Leahy for property located at 2356 Main Street for a Variance for relief from lot width requirements for the construction of a new house.

 

Members in attendance:  R. Spakauskas, S. Annunziata, J. Deignan and R. Butler.

 

The secretary read the application, Findings of Fact and one letter from Engineering pertaining to the case.  

 

S. Annunziata asked Mr. Leahy to indicate on the plan the location of the new house.  

 

R. Spakauskas asked the applicant to explain what the dotted line on the plan represents.  He said there are nine (9) acres of wooded land, there is already an existing driveway and he installed a septic system this week.

 

Mr. Donaldson, 2334 Main Street, said he lives two houses to the right of Mr. Leahy and is concerned with wetlands on that parcel.  

 

Mr. Chris Casey, 2344 Main Street, shared a copy of a letter he received in 2010 from the Department of Conservation and Recreation which stated that his property has been identified as subject to jurisdiction of the Watershed Protection Act and, therefore, was concerned about Mr. Leahy’s property falling under the same Act.  

 

R. Spakauskas asked the applicant if Pam Harding, Town Planner/Conservation Agent had walked the site; it was answered yes.

 

Linette Dolan, who has power of attorney for her mother at 2370 Main Street, addressed the Board.  She asked Mr. Leahy to indicate on the plan the location of the new house.  He did and commented that it will be closer to Cannon Road with a 1500-foot driveway.  Ms. Dolan felt that there were wetlands in that area and was concerned with the affect her mother’s well and well water would have.  She also wanted to know how wide the driveway will be and the distance from her mother’s lot line.  She commented that such a large parcel of land could eventually become a subdivision.

 

Since there were no further comments or questions, the public hearing was closed at 8:20 p.m.

 

The Board unanimously voted to approve the variance.  The Chairman asked that it be noted in the meeting minutes that the Board accepted the plan prepared by Mark R. Blanchard PLS dated May 5, 2014, Deed 46647/21 Plan 112/112.
