MATHEW & WENDY MORAN                                                                      CASE NO. V 1302

 

The Zoning Board of Appeals held a public hearing on March 21, 2013 at 7:15 p.m. in Memorial Hall in the Town Hall, 1196 Main Street, Holden, MA on the Petition of Mathew & Wendy Moran for property located at 119 Paugus Road for a VARIANCE for relief from side yard setback requirements to allow for the construction of a 2-car garage.

 

Members in attendance:  
R. Spakauskas, S. Annunziata, R. Fraser, J. Deignan and F. Lonardo.

 

The Chairman called the hearing to order.  R. Fraser made a motion to waive the reading of the application due to the fact that there was no one from the public in attendance, other than the applicant.  S. Annunziata seconded.  Vote 5-0, motion approved.

 

Mr. Moran addressed the Board.  He purchased this house in 2005 and is a third generation owner.  He explained that the trapezoidal shape of the lot with the front lot line being much smaller than the rear lot line creates a hardship of being unable to add a garage without a variance.  He con-firmed there are no wetlands in the area.  Mr. Moran said he researched similar variance requests in the past that the Board had granted.  He added that the lot is relatively flat, which will result in very little disruption and earth removal.  The adjacent drainage easement would also help to add as a building setback.  The proposed garage would have a 24 ft. wide opening with a door leading into the house.  The proposed length is 44 feet.

 

Since there were no further comments or questions, the public hearing was closed at 7:50 p.m.

 

The Board unanimously voted to approve the variance with the following condition:  1)  The southerly corner of the proposed garage must be staked by a Registered Land Surveyor six (6) feet +/- one foot from the southerly lot line.
