ZONING BOARD OF APPEALS

The Zoning Board of Appeals held a public hearing on Thursday, November 6, 2014 at 6:30 p.m. in Memorial Hall in the Town Hall on the Petition of David Cook for property located on Lot 1, Homestead Road as identified on Assessors Map 212, Parcel 52 for a VARIANCE to allow the construction of a single-family home on an existing non-conforming lot.

Members in attendance:  R. Spakauskas, R. Fraser, J. Deignan, R. Butler and R. Ricker.

The Secretary read the application and Findings of Fact.  It was noted that the application had a typo  referring to the zoning district as ‘Residential-Suburban 3’ rather than ‘Residential-Suburban 2’.  R. Butler made a motion to accept this change.  J. Deignan seconded.  Vote 5-0, motion approved.

An engineer from H.S.& T Group, Inc., representing the applicant, addressed the Board.  The land has been in the family for over 75 years.  The owner currently lives in Connecticut but would like to more back to the area and build a single-family home on the lot.  The lot is at the end of the street, but has less than 100 feet of frontage (42.75 ft.).  If the Zoning Board grants this variance, their next step would be to go before the Conservation Commission for their approval.

R. Fraser would like to see the property remain one lot and not be subdivided.

R. Spakauskas asked if there was sewer available in that area; the answer was yes.  He also asked about a buffer; the Engineer said there is a tree line as a buffer.

R. Ricker asked about the drainage easement that comes into the lot; the Engineer said they intend to keep the drainage easement as is.

A resident of 117 Homestead Road said that if this house is built it would interfere with the water flow down the street.

Elizabeth Johnson, 55 Holden Street, said she lived on Homestead Road as a child and remembers raw sewerage running down that road.  She expressed concerns with the drainage in that area and also with the aesthetics.

Since there were no further comments or questions, the public hearing was closed at 7:10 p.m.

R. Fraser made a motion to approve the variance with conditions.  R. Butler seconded.  Vote 5-0, motion approved.  The conditions were agreed as follows:  1)  The property must be connected to Town sewer;  2)  The property cannot be subdivided.  It is to remain one lot only, identified as Lot 1, 138,379 square feet on the Variance Plan submitted with the application and dated 10/8/14 and 3)  Any clearing is limited to inside the silt fence and hay bale barrier.
