JOSEPH & MARY MOOSSA                                                                             CASE NO. V 1410

The Zoning Board of Appeals held a public hearing on October 2, 2014 at 7:00 p.m. in Memorial Hall in the Town Hall, 1196 Main Street, Holden, MA on the Petition of Joseph & Mary Moossa for property located at 378 Malden Street for a VARIANCE for relief from side yard setback requirements for the existing garage to allow for the subdivision of land in order to sell the property.

 

Members in attendance:  R. Spakauskas, R. Fraser, J. Deignan, F. Lonardo, R. Butler and R. Ricker.

 

The Chairman called the hearing to order.  The secretary read the Application and Findings of Fact.

 

Mr. Ray Hurley, 7 Bounty Road, Oxford, MA, the applicant’s son-in-law, addressed the Board.  Joseph & Mary Moossa bought their house in the 1950s.  They are both in their nineties, in poor health and want to live with their son in North Carolina.  They have asked him and his wife to sell their house.  They feel that it would be easier to sell their property if they divided the lot into two parcels.  Due to the location of the attached garage, a division of the property would result in a ‘jog out’ along the side of the garage in the newly created lot in order to allow for an adequate setback from the newly created lot.

 

F. Lonardo asked why they don’t place a 15-foot jogger on it.  Mr. Hurley said this was recommended by the Building Commissioner. 

 

R. Ricker said that when he was serving on the Planning Board, they did not want any more ‘pork chop’ lots and changed their Rules & Regulations so that ‘pork chop’ lots could no longer be created.  The Zoning Board agreed they would like to get more information from Pamela Harding, Town Planner, regarding this issue.

 

Daniel Pelland, 400 Malden Street, expressed concerns with wetlands in the area.  R. Spakauskas said that does not come under the purview of the Zoning Board.

 

Since there were no further comments or questions, the public hearing was closed at 7:25 p.m.

 

The Board voted unanimously to grant the variance with the following condition:  1)  The applicant must adhere to the plan submitted to the Town Clerk’s Office date stamped and received on August 20, 2014 and identified as Job Number 5478 and DWG Number 4777.
